A sobering article from LendingTree about pet debt. "Of the 69% of Americans who are pet owners, 23% say they’ve considered going petless due to costs. By age group, Gen Z pet owners ages 18 to 27 (46%) are the most likely to consider going petless. That’s followed by 29% of?millennials... 14% of?Gen Xers.... and 7% of?baby boomers. Meanwhile, 39% of pet owners won’t own again in the future." Think it’s weird to have a provision for pets in an estate plan? It’s almost weird not to. Think about clients across all net worths and their most prized possessions (or even your own) I’ll bet pets are in the mix (and some may even be offended to call them possessions!) ?? ??? I really say ‘possessions’ because for a very long time the law saw pets as just that, a piece of property - like a chair?? So, when you made a provision in your estate plan for a pet and left ?? for someone to take care of them - there wasn’t much of a fiduciary duty of the recipient to actually use the money for the pet’s benefit. It truly put the name ‘trust’ to the test - because the person could abscond with the money and not actually take care of the pet, without much legal risk/recourse. However, over the last couple decades or so, most (if not all) states have enacted specific laws that enforce ‘pet trusts’ so you can be sure that if you leave a pet in a trustee’s care with money to support them, that the trustee has a legal obligation to use the money for the pet’s benefit. ?? In my past, I drafted provisions for the housing, recreation, and specific culinary pleasure of ‘Princess’ the cat (for real). ?? I’ve also drafted provisions leaving $10,000 to take care of “whatever pet I own at my death”. You can’t leave a pet TOO much (see Leona Helmsley’s estate), but as long as it’s reasonable, a person can ensure their furry family member is taken care of after they are gone. #estateplanning #pets

When I moved to DC earlier this year with my 3 small dogs (pictured here <3), even with housing choice, we had landlord after landlord try to take advantage of us during our housing search by requiring varying and unjustifiable fees of up to $150/month (they couldn't tell me what they would need to spend that kind of money on). One definition of "junk fee" can be found in a recent report by my alma mater The University of Texas School of Law and the amazing folks at Building And Strengthening Tenant Action-BASTA: "steep fees that far exceed the cost a landlord incurs in providing a service or remedying damage to a property." In this paper, researchers highlight pet fees as a type of junk fee, reporting on apartment complexes in Austin, TX charging as much as $1800 in nonrefundable pet fees and pet rents in a single year. Let's do the math to get the full picture - - About 72% of renters keep at least 1 pet --> Let's say that this apartment complex has 200 units. We can estimate that 144 units have at least 1 pet. - This apartment complex allows up to 3 pets ($300 nonrefundable fee per pet + $25/mo per pet). - For 144 leases signed, each with between $300-$900 in up front pet fees: This apartment complex brings in between $43,200 and $129,600 in up front pet-related fees. - For 144 12-month leases, each with between $25 - $75 per month, for between 1 and 3 pets: This apartment complex brings in between $43,200 and $129,600 in pet rent. In total, for just one round of 144 12-month leases where these units have between 1-3 pets, this apartment complex earns between $86,400 - $259,200 in pet-related fees from tenants (with exactly zero dollars refundable to tenants). I have yet to see data suggesting that these types of fees are justifiable. We love our pets, don’t we? I sure do! That’s Maggie, the best friend and cuddle buddy anyone could ask for. Having her meant room to roam and a fence were a must! With home prices skyrocketing over the past few years, it’s natural to focus on the financial aspect of buying a home. We often compare today’s prices and rates to what they used to be, but let’s not forget the personal reasons that make homeownership worth it. For some people, a big reason to buy a home is to better accommodate their pet(s). Did you know there are more U.S. households with pets than with kids? Yep, 70% have pets compared to 40% with children. Our furry friends have a big impact on how we live and where we choose to live. In fact, 43% of pet owners say they would move to find a better home for their pets. Proximity to parks and outdoor spaces is a top priority. ???? People with pets also tend to buy bigger homes. Half of all pet owners make renovations when they move to accommodate their pets—changing floors, adding fences, you name it. Pets are family, after all. So yes, it’s important to understand the financial aspects of buying a home. But let’s not forget the personal reasons that make it the right time and the right home to buy.
