Unfortunately there is a long history of law enforcement agencies allowing officers who have violated policies/laws/etc. to resign prior to those officers being terminated for their misconduct. Many times, their misconduct is then “shuttered away” through the use of a “clean records agreement.” This is often done on the advice of attorney’s for the law enforcement agencies who understand that terminating employees could result in timely and costly court proceedings which could even result in the termination being overturned. The thought is, “Just get ride of him fast.” This practice has created a system in which law enforcement agencies hand their “problem children” off to other un-expecting law enforcement agencies where the individual’s misconduct often continues. So bad Officers get to bounce from one agency to another never facing the consequences for their actions. As a profession, when we allow proven bad officers to stay in the profession we delegitimize the profession in the eyes of the public and the public loses faith in law enforcement. We are also setting up our fellow law enforcement partners to fail when we allow a bad cop to go to another agency without providing that agency with a full accounting of that Officers actions/behavior. I have seen agencies do this and a time after time that Officer in question was a problem for the new agency. The leaders from law enforcement agencies should never hide information about Officers from other agencies during the background/hiring process.
