What do AI-driven smile tracking, a tense presidential election year, and a new Taylor Swift album have in common? Each of these topics inspired one of my personal favorite Fisher Phillips Insights published in 2024. CLOSED DOORS Behind every dark look are hidden truths shutoff by the bearer from the world which it perceives to fight against. Lines of crooked faces broken from countless stitches of corrected slaps from the ruffles of judgments all around creates barricades to form doors which locks up true feelings as times fazes off. No one wishes to be let out, nor is there an allowance for a window to know what lies within. Hard bars are created overtime to shutoff more tempered effects as the ruffles scratch deeper. Dark alleys are formed overtime as more doors are shut due to resonance of frustrations from every side. Terror lies within these walls; and like every horrific story, an innocent interference comes with an unbearable consequence of being hunted by the darkness that lies within. To find a solution requires the strong one who holds the keys to the darkest of rooms and the strongest of bars; and is tougher to conquer whatever that might come out of the hunted hallows. As workplace attorneys, we have open eyes to places where many business owners have blind spots. One of the most common blind spots I see over and over again is the issue of HOW to pay people properly. The rules are really simple, but due to misinformation, ignorance or relying on the wrong sources, many business owners get it wrong. What do they get wrong? Business owners assume salaried employee = exempt employee(and not entitled to overtime). They assume 1099 means employee without all of the expense and formalities. They assume they don’t need time or pay records because they have an “understanding” with their employees on how much they will work and how they will be paid. They assume they don’t need a contract with their employee for the same reason—they have a “understanding.” There are many more. All of these assumptions can lead to expensive problems. I have so many conversations with people who say recruiting is expensive. I then try to explain that poor recruiting is even more costly. When you rush to hire, waste time on poor candidates, and sit waiting for applicants who don't show that is all money. Having to rehire the same position multiple times while losing other great employees because of workplace chaos is all money. My suggestion is to recruit and hire right the first time.

As someone that has passed along a business, I know all too well how stressful it is to let go of something and finding the right individual to take it over. This process is what helped prompt me to start focusing more on succession planning for businesses. There is so much more behind the scenes than making sure processes are documented when you pass your business along. There is a new phase and emotions you go through, and I feel it’s not discussed enough. I’ll start sharing bits of pieces of that story overtime, but I would love to hear from you! I have known some big organizations where people have left soon soon after they've joined. It’s not because these people are paid less. Not because they are not promoted. And neither because they have to work overtime. Then why? Let me tell you the real reason behind this. People leave when they have an awful leader. And by awful, I mean the leader tries to control and command the employees. The first red flag about a toxic workplace is a leader who tries to command their juniors. True leaders never try to control, they try to cooperate. They don’t command, they coordinate. If you ask your team their opinions, instead of imposing your own thoughts on them, you’ll be the leader your business needs.
