Judicial Law Clerk Tip of the Week: Make a choice. Change it later if needed. Nailing down how long it will take to try a case is a skill and comes from practice. Still, court dockets fill up quickly, and getting your case before the judge requires proper communication with the court. Always follow the proper channels and rules for having a case placed on the docket and be sure to specify the actual number of days you will need to try your case, including time for cross-examination and arguments. Don't give vague time frames like "two or three days" or "a half day to a full day." Court staff schedule hearings and trials around each other and cannot schedule your matter without knowing how much time you need. When in doubt, go with the longer time frame. You can tell the court you don't need as much time later, after you have narrowed down your exhibits and witness lists and made stipulations.

Good advice
Judicial Law Clerk Tip of the Week: There is a lot of pressure on attorneys to always have the answer to every question and have it at the ready in their mind. Whether you are consulting a client or litigating in a courtroom, lawyers can feel like they are being judged negatively if they cannot immediately recite a statute or case. This pressure sometimes leads attorneys to "fake it 'til they make it" when they are before the court and answer questions with no knowledge of whether they are correct. However, this behavior can lead to serious consequences for you and your client. A better tactic is to slow down and admit the gaps in your knowledge. It is o.k. if you do not immediately have the answer to a judge's question. You can take a moment to think and organize your thoughts. You can take a moment to look through the documents you brought to court. If you need time to comsult your client, ask for it. This is infinitely better than making something up and inadvertently lying to the court.
