How hard does a US company have to work to retain an employee? Well, that depends. If an employee is a good culture fit, but is not satisfactorily performing this job, it's up to the company to determine whether performance management for this job is an option or perhaps the employee can better contribute in a different role. Sometimes, though, the person is a complete mishire. The person you thought you were hiring was not who showed up day 1. In that case, moving to a swift employment termination could be best. In other situations, there's some combination, but the bottom line is that it simply isn't working out. There's no set answer to my question, as long as the company can articulate a legitimate business reason for the decision to end the person's employment, and there was no discrimination or retaliation in doing so. Companies often wait too long to let a poor performing and/or toxic and/or otherwise problematic employee go. There can be legal risks to every employment termination. Why HR has it harder than ever ?? Human Resources (HR) has it harder than ever now. With the explosion of remote work, it is difficult to nail down what laws apply to each employee. Where does the employee work? What laws apply in that state? It gets even more complicated for HR when they need to terminate an employee, and that employee has medical issues. What accommodations must be provided? Is the company in compliance? Is the employee qualified for leave?
