The Samsung Electronics-Nokia rumor is another example of why it would be a mistake to lump those two companies together as if they were siblings. They have some things in common, no doubt. Mutual interests, too. But there are some important differences and, at any rate, they're fierce competitors in the infrastructure business. Let's assume Samsung announces a deal to buy one of those companies' mobile infrastructure business. Who (other than, potentially, customers fearing price increases) would be more likely than anyone else in the world to complain to regulators about a concentration of market power? The other company. If one of those companies exits the mobile infrastructure business, it will no longer need cellular SEP cross-licenses. The existing deals will remain in place for a number of years, some of them for many years. If I worked in the IP department of one of those companies (I don't and won't), I'd actually be jealous of my colleagues in the other company's IP group if they got a far better opportunity to leverage the true value of their patents.
