No discussion or guidance has been given about security, legal remedies or legal liability when hacks occur. Since call centers are large, they are the more likely targets. Yet, small agencies and independent agents are potential targets also. As an independent agent, I have struggled with this issue and am not satisfied with my research or conclusions. One concern is the 10 year storage requirement. Any service I employ must be able to assure my data will be protected for 10 years with proper liability protections. It is unclear what my risk exposure is when a contractor provides a call recording service. If they are breached, can I be sued? Since health insurance is a financial product, are we subject to the Safeguards Rule? How does it work for us? CMS has mandated this procedure, they should give us better guidance on how to implement it safely and effectively. As usual, government has decreed an action without any skin in the game.
