Tapestry vs. FTC: A New Direction in Fashion Law Fashion law is heading in a new direction. Here are three key changes to watch: 1. Fashion law now covers more than just trademarks. It also looks at how brands impact the environment and how open they are about their practices. 2. Cases like Tapestry vs. FTC show that regulators are paying close attention to mergers and how they affect competition and consumer choices. 3. There’s a growing demand for brands to be responsible and ethical. New laws, such as the Fabric Act and California’s Responsible Textile Recovery Act, are pushing companies to improve labor conditions and be more sustainable. Much Ado About Fashion Law (Part 1) By: Evelyn Nguavese Apegba Esq. Indeed, fashion law is a subject of considerable interest and importance. It has become a pivotal force shaping the fashion industry. Fashion law basically addresses legal aspects of the fashion industry; many people consider it a subset of intellectual property. Factually speaking, a lot of fashion business issues fall under intellectual property rights but fashion law goes way beyond Intellectual property. It is a separate branch of specialty, but only a few law firms specialize in this area. Lucky for you, House of Justice is amongst the few and here are some of the key aspects of fashion law for your consideration: 1. Intellectual property protection: Intellectual property rights are at the forefront of the fashion law domain. The areas of protection are in trademarks, copyrights, and patents. It is important for designers to ensure that they protect their brand names, logos and trademarks to prevent unauthorized use. 2. Contract law: Contracts are the bedrock of all business transactions. They make transactions solid. The presence of a good fashion contract before entry into a fashion business, provides a structured framework for business transactions, protects the interests of both parties and contributes to a seamless and more transparent working relationship. 3. Anti-counterfeiting measures: Counterfeiting is a major issue in the fashion industry, the counterfeit market is said to be worth $600 billion per year. These counterfeit goods cause significant financial losses for brands. These measures therefore focus on preventing and curbing the production, distribution and sale of counterfeit items to sometimes unsuspecting consumers. 4. Licensing and franchising agreements: These are quite common in the fashion industry, with designers often licensing their designs to manufacturers or retailers. Fashion law steps in to ensure legal compliance and brand integrity, it is important for designers to carefully negotiate and draft licensing agreements to protect their rights and interests. 5. Employment and labour laws: Employment and labour issues are common in the fashion industry, with issues such as wages, harassment, harmful work spaces and employment terms being its focus. Designers and brands should comply with all relevant employment laws and regulations to protect their employees from danger or exploitation. 6. International trade law: The fashion industry is a global industry, fashion law steps in to provide guidance for fashion businesses looking to expand their reach to different territories. It is important for designers to understand and comply with international trade laws, including tariffs, quotas, and trade agreements, to avoid legal issues.
