Form I-9 is used to verify a new hire's identity and employment eligibility. Employers must ensure a Form I-9 is correctly completed for each employee at the time of hire. Did you know you can accept an expired document in certain situations for the Form I-9? ?? One of those scenarios is when a new hire presents an expired green card along with a receipt notice indicating they have filed for a renewal. These documents, taken together, effectively extend the validity of the green card for I-9 purposes. In this short video, I describe the process as well as a recent rule change which further extends the validity of green cards to 36 months beyond their expiration.?Reviewing I-9 documents can be tricky, so it's always best to stay vigilant and keep up with these changing rules. #I9 #immigration #HR #compliance

ATTENTION!! E-Verify Records Scheduled for Disposal E-Verify employers have until Jan. 5, 2025, to download records for E-Verify cases last updated on or before Dec. 31, 2014. On Jan. 6, 2025, USCIS will dispose of these E Verify records that are more than 10 years old. Program administrators may download the Historic Records report to retain information about these E-Verify cases. The case data includes basic company information as well as case identifiers and case resolution information. Employers who have not already done so must record the E Verify case verification number on each corresponding Form I 9, Employment Eligibility Verification, or attach a copy of the case details page to Form I 9. ?? Final H-1B Modernization Rule Effective January 17??? ? The Department of Homeland Security (DHS) has finalized the H-1B Modernization Rule, with significant updates taking effect on January 17, 2025. These changes are designed to bring clarity and flexibility to the H-1B program while strengthening compliance measures. Key updates include: ? Revised H-1B Definition ? Updates provide more flexibility for defining specialty occupations by clarifying that (1) a bachelor's degree may not always be required, and (2) positions requiring multiple degree fields are eligible if directly related to job duties. ? Deference to Prior Approvals ? Greater predictability for employers by clarifying that USCIS will defer to prior petition approvals unless material changes, errors, or adverse information arise. ? Enhanced Cap-Gap Protections ? F-1 students awaiting H-1B status can benefit from extended work authorization during delays. ? Clarity on H-1B Amendment Requirements ?
