On 26 September in Podgorica, I had the opportunity to take part in the event to mark the 50th anniversary of the Faculty of Law and in the presentation of the book ‘Pravni aspekti medjunraodne za?tite ?ivotne sredine (Legal Aspects of International Environmental Protection) by Prof. Dr Maja Kostic-Mandic. This was a great pleasure for me, also because I had the opportunity to meet many colleagues and project partners with whom the German Foundation for International Legal Cooperation (IRZ) has been working for years and to exchange ideas with them. ? It also gave me the opportunity to be one of the first to familiarise myself with this important new book. It provides a comprehensive overview of international legal sources and judgements on climate and environmental protection from various European courts, but also refers to case law from the Constitutional Court of Montenegro on the subject. The book has a sophisticated structure and a manageable size. With this approach, which allows the reader to maintain an overview despite the complexity of the subject matter, this book is probably unique in the language area to which Montenegro belongs. It is also pleasing that the reader's work with the book is made pleasant by a clear language style, but also by the visual highlighting of the text of important legal norms and the facts of some of the cases dealt with. The book also has an appendix containing translations of extracts from some of the decisions referred to in the text. There is also a summary of the official press release (press release no. 31/2021)on the so-called ‘climate protection decision’ of the German Federal Constitutional Court (order of 24 March 2021). This was created as material for an IRZ event on climate protection case law that took place in Montenegro a year ago. BALL PLLC Attorney Participates in Important Environmental Conference BALL PLLC attorney Mariana Tejado participated in a recent conference entitled “Environmental Governance in the Escazú Agreement. Boosting the Escazú Agreement: Dialogue from Academia” held at the offices of the Ministry of Foreign Affairs in Mexico City on October 15, 2024.?Participants included representatives from the Mexican Ministry of Foreign Affairs, academia, and private industry actors including representation from the energy and food sectors. The purpose of the conference was to plan efforts to speed up implementation of Escazú Agreement, an international treaty that aims to guarantee rights to increased access information and participation in environmental matters. Participants generated a commitment to collaborate among parties to develop specific strategies that promote compliance with the agreement. Work has begun with academia, but the Mexican government plans to conduct these exercises with the private sector—specifically--the creation of a network of public and private sector academics that will work with industry and government to promote compliance with the Escazú Agreement in Mexico and more broadly in Latin America. ? I have been working for over 10 years on developing and implementing the Escazu Agreement in Latin America and the Caribbean, the first binding environmental agreement in the world with obligations for protecting environmental human rights defenders. I now sit on the Implementation and Compliance Committee, which acts as an advisory body to support the Parties and the Public in realizing the agreement's objectives. The Committee has developed "Working Modalities" that outline the procedure for how it will ensure the implementation of the agreement, the rules on communications, and our role in supporting environmental human rights defenders and reporting. These rules are available online on the UNECLAC website. In particular, the Committee would like comments and suggestions on Open dialogues with Parties and the public (VI.1) Specific measures for persons and groups in vulnerable situations (VII.46 and 47) Rapid response mechanism (VII.48-50) Guidance for assessing fulfillment of admissibility criteria set out in the rules relating to the structure of the Committee (VII.23-33) The deadline to receive feedback is February 29, 2024 . #EscazuAgreement #environmentaldemocracy #environment #environmentaldefenders https://lnkd.in/e4K3nPhj

?? News from Brazil: The Public Prosecutors Office recommended the suspension of all REDD+ projects in Indigenous and collective lands in the Amazonas state. The Federal Public Ministry recommended that the negotiations, contracts and marketing shall be suspended, in Brazil or abroad, as long as all the requirements set out in the recommendation are not met: 1?? Proof of concrete effectiveness in reducing climate impacts via carbon credits/REDD+ through reputable and internationally recognized scientific studies. 2?? Demonstrating that the rights of Indigenous Peoples and traditional communities in the state of Amazonas, as well as their traditional territories, have not been violated as a result of the negotiations and implementation of these projects. 3?? Free, prior and informed consent with Indigenous Peoples and traditional communities potentially affected by the projects under the terms of ILO Convention 169. 4?? Regulation of the issue, with respect to the three items above, in order to create legal certainty for the Peoples and guarantee the proper application of the principles of prevention and precaution. ???Reflections on a Recent Case on Servitudinal Rights Nayna Cara and I recently looked at a case that presents some compelling observations for the property and environmental sectors in South Africa. The case serves as a reminder of the need for harmonious planning and consideration of both property and environmental aspects in the early stages of large-scale developments. It emphasises that while arbitration is a valuable tool for resolving disputes, clear and respected servitudinal rights at the outset of projects are equally important to avoid prolonged disputes and encourage co-existence of competing rights. Remember, careful planning and foresight in property and environmental considerations can help prevent expensive and time-consuming disputes in the future. [AZE version on comments????] ?? Dear fellas! We present to you the next interesting case summary prepared by the FELAS team within the framework of the "Case corner" project. ?? Case background: On 31 May 2010, Australia started proceedings against Japan in respect of “Japan’s continued pursuit of a large?scale program of whaling under the Second Phase of its Japanese Whale Research Program under Special Permit in the Antarctic”. In accordance with the 1946 International Convention for the Regulation of Whaling, Australia claimed that Japan had violated international obligations regarding the protection of the marine environment, and that the whales were being killed for commercial purposes. Japan rejected the allegations, stating that Article 8 of the mentioned Convention clearly stipulates the need to kill, take and treat whales for scientific research purposes. ?? Approach of the International Court of Justice (ICJ): ?? Rationale: The Court pointed out that Japan was obliged to observe the “precautionary principle” when deciding whether the program was for “scientific research purposes”. After considering the design and implementation elements of the program, in relation to the application of Article 8 § 1 of the 1946 Convention, the Court noted that the program could be broadly characterized as “scientific research”. However, the evidence presented confirmed that the implementation of the program was not reasonable in relation to its stated scientific objectives. It was also found to be violating prohibitions on commercial whaling in Japan’s Southern Ocean Sanctuary. ?? Judgement: The ICJ has ruled that Japan’s whaling program is not conducted for “scientific research purposes” and thus, its program must be stopped immediately. ?? In this context, precautionary principle involves the adoption of preventive measures to address potential risks to human health or the environment. This principle emerged in the 1970–80s in German environmental law, and was later incorporated into international law in 1987 at the “International Conference on the Protection of North Sea”. #FELAS #ICJ #Casecorner
