Online sales aficionados - have you read the recent CMA cases relating to the resale of UK football club branded clothing? The decisions are from September 2022 and July 2023 - admittedly not brand new. They both relate to resale price maintenance (RPM) in the online context. Noteworthy: (i) asking a reseller not to offer its standard free shipping for certain products is a hardcore restriction and de facto RPM; (ii) increasing the Recommended Resale Price (RRP) for a specific product a few weeks after the product is being offered by resellers to consumers and asking resellers to consider the new RRP when setting their resale price going forward is a hardcore restriction. The decisions illustrate how seemingly legitimate conversations around how to sell products / communication of RRP can easily slip into dangerous territory leading to high fines. #distribution #ecommerce #antitrust #resalepricemaintenance #brandprotection #onlinesales #cma https://lnkd.in/eGBaxtam
