A caravan of Indigenous Mapuche activists recently concluded an 847-km (526-mi) trek down Argentina’s Chubut River, meeting with communities along the way to raise awareness of the issues they face along the shared waterway. From each trawün, or gathering, they determined that Indigenous access to land and water is diminishing, that large-scale projects on their lands are going ahead without their prior informed consent, and that Mapuche communities need a unified stance toward state decisions. Huge swaths of land along the river have been bought up by private interests, including foreign millionaires, cutting off access for the Mapuche to the Chubut that they consider not just a physical resource but a spiritual entity. The Mapuche are also concerned about policy changes under Argentina’s new libertarian administration, which has already kicked off a massive deregulation spree and could lift a ban on open-pit mining in the region. https://lnkd.in/grRxKQWe

Drea Burbank, we have to be careful not to confuse two different matters here. Indigenous people need the recognition of their land rights. In Suriname, Hugo Jabini has been fighting for decades for this cause, sometimes at risk to his life. He has the backing of a team of world class lawyers who have already won multiple cases against the Government of Suriname (GOS) to get their land rights recognized. On the other side there are those seeking carbon credits for Suriname's forests. These people have supproted the GOS to argue against the recognition of land rights. If the GOS manages to receive these carbon credits, decades of work by Hugo and other indigenous leaders will be set back bc the government will have less incentive to recognize their land rights. Keep in mind that all scientific evidence shows that biodiversity and forests are better protected when indigenous and local communities have rights to their lands. In my opinion, carbon credits should be conditional on land rights. So, my question is: who will the lawyers support that you are calling to action? Landmark Ruling for the Indigenous Rights to rainforest in Suriname A recent court ruling in Suriname has granted protections to 535,000 hectares of rainforest, marking a significant victory for local and Indigenous communities. This decision comes in response to ongoing threats from agricultural expansion, logging, and mining, which have endangered these vital ecosystems and the cultural heritage of the Indigenous peoples. The initiative was driven by Indigenous leaders and international advocacy groups, with legal battles dating back to the 1990s. Significant progress was made with the 2007 Inter-American Court ruling in favor of the Saamaka people. The decision emphasized the need for free, prior, and informed consent (FPIC) for development projects, reinforcing international human rights standards. Size and ecological characteristics: The protected area includes 535,000 hectares of rainforest, home to rich biodiversity and critical ecosystems vital for regional ecological balance. Methodology and funding: Efforts involve legal actions, international advocacy, and environmental monitoring, supported by local resources, NGOs, and legal aid organizations. Achievements: Legal recognition of territorial rights and the halting of some development projects threatening these areas. Ongoing challenges include enforcing court rulings, combating illegal activities, and managing economic pressures from extractive industries. ?? The More You Know: Victory for Indigenous Rights in Québec! ?? I participated in a focus group that considered funding opportunities to enhance access to justice for Indigenous communities in Northern Ontario. During our discussion, an individual shared insights about land rights and developments in a neighbouring community in Québec regarding the ongoing challenges with protecting the exploration rights from the Crown and mining companies on their traditional Indigenous lands. ... ?On October 21, 2024, the Superior Court of Québec reinforced Indigenous rights, ruling that the Québec government must consult the Mitchikanibikok Inik First Nation (Algonquins of Barriere Lake) before granting or renewing mining claims on their ancestral lands. For years, the Mitchikanibikok Inik First Nation has fought to protect its territories—rich with heritage sites, critical habitats, and essential resources for traditional practices—from mining activities that have not consulted with them. With the legal expertise of the Centre québécois du droit de l’environnement (CQDE) and Ecojustice, they secured a court mandate that Québec must respect the duty to consult and accommodate Indigenous nations. This reinforces a solid message: free-entry mining practices that bypass Indigenous consultation are unconstitutional. This decision joins other landmark victories, including those of the Ross River Dena Council in Yukon and the Gitxaala and Ehattesaht First Nations in British Columbia. ?? "Inevitably, the sale of carbon credits in Guyana—or in nearly any rainforest territory—intersects with issues of human rights and Indigenous peoples’ land tenure rights. Approximately 36% of the world’s remaining primary forests and at least 24% of the above-ground carbon in tropical forests are located within Indigenous peoples’ territories. Without explicit and legally binding commitments that guarantee the rights of Indigenous peoples, the carbon market will continue to undermine the world’s most effective forest guardians." Nicholas Peters, the Advocacy and Policy Support Officer for the Amerindian Peoples Association (APA), wrote of APA's concerns about the carbon credit certification process. APA is a non-governmental organization that advocates and promotes the rights and development of Guyana's #Indigenous Peoples since 1991. "Our work with Indigenous communities over the years also reveal that there are crucial unresolved land tenure issues," Peters writes. "It is critical that major carbon crediting standard administrators, their validation and verification bodies, and potential buyers seriously note how complaints in crediting activities are handled to ensure rights protections are effectively respected and that underlying issues are adequately addressed. Failure to do so may not only exacerbate conflicts in Guyana but could cast a shadow over the integrity of forest carbon markets across the globe."
