Meet Tom! THOMAS BENNETT is the Investigation & Judgment Enforcement Manager at Smith Carroad Wan & Parikh. Mr. Bennett began his career the week he graduated from high school in June 1984, in the collections departments in the leasing industry. A career supervisor and manager, Mr. Bennett joined Smith Carroad Wan & Parikh in October 2003 as a Legal Assistant and quickly moved up the ranks. Mr. Bennett oversees the skip tracing, asset location, and investigative departments, and is the primary on-boarding staff trainer. Tom’s hobbies include gardening, music, and particularly loves vinyl records.

A huge congratulations to Palm Beach County for moving to the 24/72 firefighter work week! This just proves that even a large county can see the benefits of this proactive shift. . Congratulations to Local 2928 Palm Beach County Fire Fighters on securing an amazing 3 year contract for their members. Some of the highlights are listed: 5%-4%-3% COLAs with a new 42 hour workweek 24/72 schedule. Increase in instructor pay and special event pay to $50/hr. For instructors, once you hit FLSA max, teaching is at your normal OT rate. No reduction in our vacation banks or holiday accruals. Incentives for FO1, FO2, Airboat Operator, Personal Rescue Watercraft, Arson investigation, lead fire inspector. Totally new pay plan for our communications employees that will result in a 22+ % raise. People who are still in the step plan will get 10%-9%-8% over 3 years, which is over 50% of the department.

Said another way, when you take on a task, finding the best ways to achieve the desired result is always your responsibility. This doesn't mean diving headfirst without a plan, but it does mean taking initiative and ownership when you raise your hand. Is there a better way to approach the task? Can you leverage existing tools or resources in a new way? It doesn’t really matter *how* you get it done, but that you take ownership of getting it done.

What do litigation and white-water kayaking have in common? Last weekend I competed in the Avon Descent – a two-day, 124km white-water kayaking race. High water levels made for a quick and dramatic course. After four years of competing in this event, I’ve noticed a few things that white-water kayaking and litigation have in common: 1.?????Pick a line – when approaching rapids there are often several possible lines to take. Some will be good, some bumpy, some simply bad. But the worst option is to fail to pick a line or to continuously second-guess. As I know all too well, the result is always inevitable – you end hitting a rock or tree, falling out of your kayak or going down the rapid backwards or outside of your kayak. Ditto litigation. Assess the options, pick a line and hang on tight. 2.?????Feedback is crucial – when kayaking in a group, watch the person ahead closely. If the leader has found a good path through the rapid, follow them. If they’ve run into trouble, consider another line. Ultimately, all feedback is good. 3.?????Plan ahead and prepare to improvise – the Avon River has a 40 km stretch of rapids. Once you start, it is completely inaccessible to vehicles and there is little phone reception. You can only head downstream. If the kayak springs a leak, snaps a rudder cable or sinks, you’re in for a long walk. Good kayakers plan ahead – they have a spare paddle, a roll of gaffer tape to seal holes and spare rope. They improvise and find a way to the finish line. Litigators do the same. 4.?????Watch the surface for signs - when kayaking on a wild river, any disruption on the surface can suggest rocks, trees and other obstacles underneath the water. In legal practice look out for the less obvious signs in your clients, witnesses and the case generally. Sometimes those can be critical to resolving a matter. 5. You end up where you look - if you fixate on the rocks and fallen trees, you will end up hitting them. Look at the path you want to take and paddle hard. With litigation - focus on solutions, rather than the problem. ? So, to all those lawyers looking for a new sport, see you at the start line of the 2025 Avon Descent.
