TRUMP ELECTION SUBVERSION REPORT FROM JACK SMITH MIGHT EVENTUALLY COME OUT TO THE PUBLIC The U.S. Department of Justice (DOJ) has announced plans to release a portion of Special Counsel Jack Smith's report concerning President-elect Donald Trump's alleged attempts to overturn the 2020 presidential election results. This report is part of a two-volume investigation, with the first volume addressing election interference and the second focusing on the handling of classified documents at Mar-a-Lago.?Attorney General Merrick Garland intends to make the first volume public, while the second volume will be withheld due to ongoing legal proceedings involving Trump's associates, Walt Nauta and Carlos De Oliveira. These individuals face charges related to the classified documents case, and their legal teams have expressed concerns that releasing the full report could prejudice their clients' rights.?U.S. District Judge Aileen Cannon has temporarily blocked the report's release until the U.S. Court of Appeals for the 11th Circuit reviews the matter. This decision follows objections from Nauta and De Oliveira, who argue that public disclosure could impact their ongoing cases.?The DOJ has proposed providing a redacted version of the second volume to select members of Congress, balancing public interest with the need to protect the integrity of ongoing legal proceedings. The timeline for the report's release remains uncertain, pending further legal developments.?

DEVELOPING- Trump will likely be tried in DC before election. But it will be a pre-trial before the real trial. Let me explain. NOTE: The court case against Donald Trump for alleged election interference is now officially back with U.S. District Judge Tanya Chutkan. NOTE: She has to figure out how much of the case can continue, based on a Supreme Court ruling that gives former presidents a lot of legal protection for official acts. Her initial decision could come as early as Monday in just over two days. NOTE: The Supreme ruled last month that former presidents cannot be prosecuted for official acts. NOTE: To determine what call be tried and what should be dropped based on the Supreme Court’s ruling, Judge Tanya Chutkan will likely ask the parties for written arguments and possibly hearings. NOTE: However, the trial won’t happen before the upcoming November presidential election. If Trump wins that election, his federal cases might be dropped. NOTE: My guess is Judge Tanya Chutkan will call for hearings to determine what falls under official acts and what doesn’t. NOTE: Special Counsel Jack Smith will then call a sea of witnesses, effectively turning the pre-trial into a trial before the election and even request that Trump should be present. NOTE: We’re entering a tumultuous time, especially with the potential sentencing in New York next month.

Are you prepared to say today, under oath, without reservation, that Donald Trump lost the presidential contest to Joe Biden in 2020?” Durbin asked. “President Biden is the president of the United States. He was duly sworn in, and he is the president of the United States. There was a peaceful transition of power. President Trump left office and was overwhelmingly elected in 2024,” Bondi responded. Pressed further by Durbin, Bondi continued to equivocate: All I can tell you, as a prosecutor, is from my first-hand experience, and I accept the results. I accept, of course, that Joe Biden is president of the United States. But what I can tell you is what I saw first-hand when I went to Pennsylvania as an advocate for the campaign. I was an advocate for the campaign, and I was on the ground in Pennsylvania, and I saw many things there. But do I accept the results? Of course, I do. Do I agree with what happened? I saw so much. You know, no one from either side of the aisle should want there to be any issues with election integrity in our country. We should all want our elections to be free and fair, and the rules and the laws to be followed. “I think that question deserved a yes or no. And I think the length of your answer is an indication that you weren’t prepared to answer yes,” Durbin said."

NOTE: The documents, though largely redacted, were disclosed following Judge Tanya Chutkan's ruling that Trump’s delay request could potentially interfere with the election. NOTE: The case accuses Trump of conspiring to overturn the 2020 election results. NOTE: A Supreme Court decision granting Trump “presumptive immunity” forced special counsel Jack Smith to revise the indictment, removing references to key officials. NOTE: Chutkan emphasized the public’s right to access the records, dismissing claims that the release would constitute election interference. NOTE: The unsealed documents detail the names of organizations that were paid to organize the rally leading to the chaos on January 6. About 2.5 million dollars was spent on the rally. US ELECTION - Trump Garners Landmark Ruling on Absolute Immunity From Prosecutions as Supreme Court Delays Trial (By Yuto Haga, July 1, Mon.) - Former President Donald Trump won a historic verdict from the Supreme Court (SCOTUS) after Chief Justice John Roberts threw out a lower court's denial of the 78-year-old's claim of immunity from any criminal charges involving his efforts to nullify the 2020 presidential election loss to Joe Biden. This bolsters the case that Trump could overcome alleged criminality to dislodge Biden from his Oval Office, since the most famous US presidential candidate is now all but certain, at least until the November election, to relish exemptions from being convicted on "acts within the outer perimeter of his official responsibility (quoted from Roberts' statement)." "We conclude that under our constitutional structure of separated powers, the nature of presidential power requires that former president have some immunity from criminal prosecution for official acts during his tenure in office," the Chief Justice wrote. The verdict is a 'partial' victory for Trump since half of his four alleged misconduct contained in indictment were ruled to be noncriminal, but the others, including incitement of a capitol riot in Jan 6, 2021, were left unsettled and sent to lower courts. Traders reacted to the news by selling Treasuries and buying the dollars as the 10-year bond yield approached 4.5%, with roughly 30bps left to match the 2-year counterpart, and the euro-dollar erased all the daily gains stemming from the calmer-than-feared French election result announced overnight.

As the 2024 election approaches, it is clear that we may face another tense post-election period. Former President Trump has already indicated the possibility of disputes if the results are not in his favor. However, there is good news: the legal landscape has evolved since 2020, making it more difficult to disrupt the electoral process. Key developments include: New Laws: The Electoral Count Reform Act of 2022, which Leadership Now advocated for, prevents delays and schemes like fake electors that we saw in 2020. Court Rulings: The Supreme Court’s ruling in Moore v. Harper, where Leadership Now filed an amicus brief, closed the door on extreme interpretations of state legislature powers. Additionally, lawsuits alleging election irregularities have been largely dismissed. Stronger Guardrails: States have implemented tighter election rules, and many legal loopholes from 2020 have been addressed, making it harder for frivolous legal challenges to succeed.
