When we agree, we don’t need the law—a handshake is as good as a contract, and maybe better. Our leaders negotiate and reach reasonable conclusions. Dispues get worked out. The law is what helps us to live in the same society when we don’t agree. It’s never been more important than now. I’m looking forward to a lively discussion!

Thank you to the Council of Michigan Foundations for the opportunity to share fraud-fighting best practices with the foundation community. The session offered many tips on how foundations can collaborate with their partner and awardee organizations to collectively prevent fraud. To avoid a commercial-like presentation, we shared some of our “secret sauce,” including many do-it-yourself tips and tricks, and even our engagement letter template and tasks, so attendees had a roadmap to perform these tasks themselves rather than needing to hire a third party like us. For those who need to hire a third party for fraud prevention services, we shared best practices and tips on managing that relationship, including the dos and don’ts we’ve learned (some the hard way) from performing this type of engagement with several organizations. Do you work for a foundation or municipality responsible for awarding funds but lack internal resources to help your partners? We have multiple relationships with foundations and governmental organizations that provide additional funding to their nonprofit partners specifically to hire us to enhance their fraud prevention toolkits and reduce fraud risk. This is a win-win scenario, as neither organization wants to end up in the headlines due to embezzlement, but often both lack the expertise or personnel to proactively address it.

Looking forward to the conference and my panel on Legal Holds: Once We’ve Got Them, What Do We Do with Them?
The Working Group 1 Annual Meeting is coming back to Phoenix on Oct. 23-25, with 10 sessions on the agenda and a distinguished cast of eDiscovery experts leading the dialogue at the Hyatt Regency in the heart of downtown. Our Voices from the Bench panel will feature judges Elizabeth Chestney of the Western District of Texas, Lisa Cisneros of the Northern District of California, Joel Richlin of the Southern District of California, Scott McCoy of Maricopa County Superior Court and Juan Villasenor of Colorado's Eighth Judicial District and be moderated by Robert Keeling. By popular demand, we've added a second Case Law Review session, both moderated by the incomparable Philip Favro. We're also devoting sessions to Judicial Safety and the Duty of Civility as well as Practical Uses and Considerations of Artificial Intelligence. And we will be reviewing and soliciting membership feedback from several in-progress drafting team efforts, including: The Sufficiency of Rule 26 Initial Disclosures; Managing, Modifying, and Lifting Legal Holds; and Discovery Implications of the Internet of Things. More than two dozen dialogue leaders are already confirmed, including Kelly Atherton; Elliot Bienenfeld (CIPP/US); Hildy Bowbeer; Vince Carnevale Esq, PMP; Jennifer S. Coleman; Andrea D'Ambra; Gareth Evans; Joseph Guglielmo; Alicia Hawley; Todd Heffner; Jeannine Kenney; Nathanial McPherson; Claudia M.; Chad Roberts; Maria Salacuse; Clinton Sanko; Dan Stromberg; Cristin Traylor; and Kenneth Withers. Before getting into the meat of the conference we'll gather for a welcome cocktail reception on Wednesday, Oct. 23, where we will spend some time sharing memories of Craig Weinlein. Join us from 5:30 to 8:30 p.m. for cocktails, hors d’oeuvres, and live music by Craig’s band members, Guitarras Latinas.
