?? 7 Major Concerns of the Digital Personal Personal Data Protection Act, 2023. 1. The definition of personal data under Section 2(t) is narrow, flat and flexible in nature, which has its own advantages and disadvantages. 2. The Act failed to classify and address the notion of sensitive and critical data (racial or ethnic origin, political opinion, religious beliefs, sexual orientation and others). 3. The Act does not have any provision regarding the processing of personal data arising out of contractual obligations. 4. The redressal mechanism available for the aggrieved data principal do not comprise of any methods of compensation to the victim in case of personal data breaches. 5. The central government is said to be vested with exemplary powers to exempt itself in certain cases, and has its own discretion in forming the pannel of the Data Protection Board. 6. The Act do not specify any limitation or time framework for addressing the issues of data breach, which may led to delay in delivery of justice. 7. The Act weakens the Right to Information by granting more discretion to deny the information sought. ?? Why DPDP - The Ultimate Requisite. Looking forward to connect.
