These are great steps to encourage business engagement and a thriving economy.

I have been watching with interest the progress of the independent review into the Franchising Code of Conduct by Dr Michael Schaper (who is also a Board member of the Small Business Development Corporation) and welcome the Federal Government’s response which effectively endorsed all recommendations. I echo the Australian Small Business and Family Enterprise Ombudsman, The Hon Bruce Billson GAICD, views that litigation can be a tool that more ‘cashed up’ and powerful entities employ against smaller businesses that they’re in dispute with to drain their resources (see the ASBFEO media release linked below). This was the motivation behind the Small Business Development Corporation, ASBFEO and my Small Business Commissioner counterparts across Australia introducing low cost (or free) dispute resolution services, to help parties in dispute arrive at a negotiated outcome and avoid the costs and time wastage of going through the courts. ? I am pleased to be invited to speak quite regularly on franchising matters and, while I welcome any protections offered to make the business playing field more ‘level’ – regardless of business size and muscle-power – I feel it is important to note that most franchisors (which can also be small businesses) aren’t out to take advantage of their franchisees. Like any other business model, those entering into a franchise agreement must do their due diligence before taking the leap. ? As always, my team at the SBDC is ready to assist prospective franchisees, and small business franchisors, based in WA with free small business advice. And should the relationship start to go downhill, we can also assist with our free dispute resolution process or subsidised mediation to help parties arrive at a mutually acceptable outcome. ?
