Assisted Dying Bill has been helpfully shared for those of us who can't navigate the Parliament website (thanks Kirsty). I've two initial thoughts - I would love to know what my community think of it. 1. A much needed definition of an Expert in Mental Capacity. I wonder if we'll see this wording in future updates to the MCA? "(11) In this section, “appropriate specialist” means a registered practitioner (other than the attending doctor or independent doctor) who is registered in the specialty of psychiatry in the Special Register kept by the General Medical Council.?" 2. There's nothing in here relating to LPAs and instructions to attorneys around assisted dying. An initial glance would indicate that it wouldn't be possible for a donor to put an instruction into the LPA as: (a) they wouldn't be able to demonstrate capacity to the two attending doctors or the appropriate specialist per s.3; and (b) there is no opportunity for pre-election as the Order can only be applied for if the prognosis is 6 months or less.
