?? Significant Construction Industry Ruling ?? Kenney & Sams, PLLC construction law attorneys, J. Nathan Cole and Ross Wecker, recently obtained a significant decision in favor of their client, J.C. Cannistraro, successfully arguing that a violation of the Massachusetts Prompt Pay Act voided a claim brought against their client. The Norfolk Superior Court held that where a general contractor violated the Prompt Pay Act, the arbitrator exceeded his authority by allowing the GC to pursue a recoupment claim for that portion of the payment “deemed approved” because it brought the claim before it made payment to Cannistraro. This case highlights the complexities of the Prompt Pay Act and reinforces the importance of timely and good-faith compliance with the Act. Few things are more frustrating than being in court and realizing that the judge does not understand construction disputes and has no desire to understand the construction dispute before them. This normally means they won’t rule on motions that narrow the issues and will take a “let’s just let a jury sort it out” approach. This is why for most construction cases, if there’s an arbitration clause, I push the case to arbitration. There’s added administrative costs but trust me when I tell you that it is worth it when you consider that a lot of nonsense is typically eliminated when the arbitrator understands construction law. You don’t have to worry about ending up in front of a jury defending 10 different causes of action or addressing 20 inapplicable affirmative defenses that should have been eliminated as a matter of law. You can focus on the actual issues in the case and save everyone a bunch of headaches. Moral of the story, if you’re doing construction put an arbitration clause in the construction agreement. #Construction #Constructionlaw #Contractor #GeneralContractors
