Fascinating story. Every follower of mine should read this post -- it is important. What this article (link: https://lnkd.in/eax-EqEz) is referring to as a "data breach" is a case where people had access to folders on a shared drive that they should not have had access. In this case -- people with access to the computer shared drive were able to view the private folders of some elected officials. This happened to me once. I had instructed my IT vendor to create some private folders where only I was supposed to have access. Well -- it was not set up properly and any employee with access could theoretically view the contents. Thankfully, I caught it and never had any reason to believe anyone had accessed them. However, I was very irritated by this as I was explicity clear with my request. My advice to anyone reading this post is to double check your folder permissions, especially for any electeds and members of the executive staff, with your IT team. Reprimands again. Southend Council gets a reprimand from the Information Commissioner's Office for the perennial issue of disclosing hidden spreadsheet data in response to an FOI request. Here, the information included personal data, including special category data, of employees, “office holders” and agency workers. One notes the mitigating factors, but one also notes that the council wasn’t properly aware of the risks. As I mentioned only recently, this has been a known risk for at least a decade, so leniency (ie reprimand, not fine) is perhaps surprising in the circumstances. https://lnkd.in/ecyDf6d8

Here is the story: Allan submitted his CV to the Migori County Assembly as part of his application for the position of Speaker. The Assembly published his CV on their official website, making it publicly accessible. Alan argued that this amounted to unauthorized disclosure, violated his right to privacy and exposed sensitive personal information, including the personal data of third parties listed as referees in his CV. The Assembly argued that by applying for the position, Allan had subjected himself to rules requiring disclosure of his personal information to the Members of the County Assembly. They claimed that the Standing Orders of the County Assembly mandated the publication of candidate information. ?????? ???????? ???????? ????????: ?The Publication of Allan’s CV violated Sections 25(a) and 25(c) of the Data Protection Act. While the Migori County Assembly Standing Orders required the sharing of the CV with the Assembly Members, the public dissemination of this information went beyond the purpose limitation principle. ?The Assembly’s reliance on the Standing Orders did not provide lawful grounds to publish the CV publicly. Section 30 of the Act requires either consent or a lawful basis for processing personal data, which the Assembly did not demonstrate. ?Given the sensitive nature of the personal data and the ongoing violation, the Data Commissioner awarded KES 900,000 in compensation to the Complainant. The ODPC also issued an Enforcement Notice against the Assembly to delete the CV from the website within seven days. ???2 ?????? ??????????????????/?????????????????? ?????? ?????? ??????????????????????????: ?While it seems customary to include referees’ contact details in CVs, modern practices and legal frameworks suggest rethinking this approach. Opting for “contacts available upon request” is a safer and more privacy-conscious way to manage such information. ?Before listing someone as a referee, take steps to ensure their data is protected. Failing to do so can harm relationships and expose them to unnecessary risks. Always communicate openly with your referees about how their information will be used and seek their preferences on how it should be shared. ?? ???? ???? ?????????????????????????? & ????????????????????: Referees’ contact details may seem like harmless information, but in today’s digital age, even basic contact info can be used for unwanted purposes. Instead of requiring full contact details, you can accept that references be named, and their contacts be availed upon request.
