In the late 1800s, five universities - Wisconsin-Madison, Yale, Columbia, Hampton and Cornell - educated key leaders of the growing labor movement, advancing ideas around workers' rights. Thinkers like Richard Ely, William Sumner, Samuel Gompers, Henry George and Booker T. Washington were nurtured at these schools. By developing this intellectual core, the universities helped drive progress in bargaining, power balance, and conditions for industrial and farm workers. The Regional Director's decision in Dartmouth (linked in the article) does a good job explaining why the Board doesn't have the jurisdiction problem that it had in Northwestern University because all of the Ivy League schools are private. In other words, in Dartmouth, the Board would have jurisdiction to certify a conference-wide bargaining unit (i.e., a multi-employer unit), like the NFL and NBA. In my view, this decision shines a spotlight on the jurisdictional problem in the USC/Pac-12/NCAA case where the NLRB is only asserting the joint employer rule against the conference and the NCAA to try to get around it. The joint employer rule is not the equivalent of, and serves a different purpose from, a multi-employer bargaining unit. See Karcher, R. (2023). The NCAA as joint employer? So, what's the right path? What should higher education do when core values appear threatened by a political candidate? PROACTIVE DEFENSE Stand firm publicly on values like diversity and justice, making it clear future threats are unacceptable to core institutional values. ?? Bold but quick to veer into partisanship. INTELLECTUAL OPENNESS Advocate for further intellectual debate on campuses, trusting students to see through ideological threats themselves. ?? Noble, and a tad naive. BALANCED APPROACH Affirm values quietly through internal policy, but avoid public stances to empower all (including students) to weigh issues independently. ?? I just had another school leader reach out to me about this faculty compensation model Unfortunately, like many things, it's so easy to slip into limiting our philosophy to “obvious” areas like mission statements, curriculum decisions, and in the boundaries we put in place to hire mission-fit employees ... all of which are absolutely essential. Unintentionally, we can leave many of the more “neutral” areas of our school untouched – like report cards, bell schedules, homecoming dances, and compensation models. Without question, how a Christian school approaches conversations around gender or creation accounts need to be held under the lens of our school missions and in constant dependence upon a biblical foundation. But, so should everything else ... include the way we think about paying our people. While our financial constraints may limit our capacity currently, our philosophy certainly shouldn't. Also as it relates to the title of this article, the University of Tennessee is mentioned along with a few other public universities who are experiencing explosive growth. In my career I’ve had the privilege of working with numerous Harvard grads (mostly MBAs and attorneys) and when they would inquire as to where I obtained my graduate degee I would say “Hillbilly Harvard”. Go Vols! The Southern enrollment surge is taking place in some booming regional economies. The top five most promising locations to find work for newly minted college graduates are all in the South, according to a recent study by payroll provider ADP.

The Fifth Circuit recently outlined a new standard for employment discrimination claims under Title VII in Hamilton v. Dallas County. Its more recent decision in Harrison v. Brookhaven School District provides additional guidance on what constitutes an actionable "adverse employment decision."
