As we previously mentioned earlier that there is an proposed amendment presented before the Senate regarding the 2025 National Defense Authorization Act. Which would significantly increase the ability of federal Contracting Officers to award sole source contracts to WOSBs, HUBZones and SDVOSBs. The proposed amendment would eliminate the “rule of two” restriction, under which a Contracting Officer can only award a sole source contract under these programs’ authority if the Contracting Officer does not expect to receive two or more offers. BLUF, the amendment would allow sole source awards under the applicable dollar thresholds regardless of competitive potential, which very similar to the 8(a) program. Current trends demonstrate the 8(a) Program accounted for more than 95 percent of “SBA” sole source dollars awarded in FY 2023. NEW: FAR Council Implements Clarification on ANC Subcontracting Plans and Mentor-Protégé Program The proposed rule implements a clarification that as a #subcontractor, an Alaska Native Corporation (ANC) does not need to also submit a subcontracting plan if the firm does not individually qualify as small. U.S. Small Business Administration issued this change back in 2020, citing that ANCs are always treated as small businesses according to statute. Additionally, two new incentives are created for SBA's #smallbusiness mentor-protégé program for protégés whose principal office is in Puerto Rico or a covered territory. If this is the case, the mentor can receive positive consideration for the mentor's past performance evaluation and is also able to apply costs incurred for training provided to the protégé to its subcontracting plan goals. Although SBA asked for clarification on the term “positive consideration” in the implementation of this FY2019 NDAA language, it is not defined in SBA's final rule, leaving the interpretation up to the acquisition workforce.
