The Motor Ombudsman, the Ombudsman dedicated to the automotive sector, is marking two decades since it was announced that the Motor Industry Code of Practice for New Cars received full ‘Stage Two’ approval from the former Office of Fair Trading (OFT). Superseding the Motor Industry Code of Practice, unveiled in 1976, the New Car Code was the first Code of Practice from any industry to achieve this prestigious status. Being given the green light in September 2004 meant that the Code was deemed to be effective in promoting and safeguarding the interests of motorists, and provided added protection to consumers when buying a new car. “We strongly encourage Volkswagen to heed our call to abide by California law and immediately stop offering Scout vehicles directly to consumers without using their business partner local dealers,” California New Car Dealers Association President Brian Maas said in a statement.
The California New Car Dealers Association said the two companies’ plan to sell Scout vehicles direct to consumers “wrongfully cuts new and existing VW dealers out of an opportunity” and directly violates a section of California’s law covering new-vehicle sales.

CARS Rule - Vacated. Today, the National Automobile Dealers Association (NADA) and Texas Automobile Dealers Association prevailed against the FTC in the 5th Circuit Court of Appeals. The Court vacated the FTC's Combatting Auto Retail Scams (CARS) Rule, which was also known as the Vehicle Shopping Rule, due to procedural shortcuts by the FTC before passing the Rule. While the FTC can restart the process if it chooses, with the change of administration, this is likely a longer-term victory for the automotive industry. However, before anyone celebrates too much, understand that the FTC never needed the Rule in the first place. In fact, the FTC has taken many actions against dealerships in the past 5 years using other authority for conduct that would have also run afoul of the now vacated Rule.

Consumers should be able to feel confident that car dealerships will fulfill their promises and stick to the financing terms agreed to at the time of purchase, especially when the buyer leaves the lot with the vehicle. That's why the Consumer Alliance of Oregon is endorsing House Bill 3178, Transparent Auto Financing, this legislative session. This bill would ensure fair and clear financing at a car dealership, including: A 4-day financing window (instead of 14) Notification about the terms at the time of sale If financing cannot be finalized: ?? Dealer's options would be to 1) carry the loan or 2) void the contract ?? If the sale is voided, buyers must be notified within two days ?
