A couple years ago I spoke at the Institute for Energy Law conference about the increasing risks of nuclear verdicts for energy corporations. Juror attitudes about the environment seep into their decisions about cases, even when toxic exposure isn't germane or relevant as it was here. This verdict illustrates the importance of rigorous mock trial testing and diligent jury selection procedures for energy companies. The final damages number may be emblematic of the vitriol or frustration some jurors feel toward oil & gas companies in particular, and this kind of verdict is very rarely the result of a single 'rogue' juror. #jurytrials #litigation https://lnkd.in/es_FUzQp

Our AES colleague, Spencer Shute, attended the AMEC WA Environmental Legislation Forum on 12 June, gaining insights on the current State and Commonwealth regulatory reforms. The latest updates on the Commonwealth Government’s EPBC Act and Nature Positive reforms are: - Large increase in non-compliance fees - Proposed 6 week ‘early consultation period’ prior to referral (to gain stakeholder feedback and allow changes / alternatives to be addressed in referral) - Requirement for a Stakeholder Engagement Plan - General move away from purchase of land for offsets towards restoration works - Offsets sought prior to impact, but potential to have offsets set under Conditions - Changes to Nuclear Action trigger (such that mineral sands and rare earths projects would be unlikely to exceed trigger) The WA Government’s EP Act reforms include: - EPA guidance being reviewed and updated, in particular: ~ Changes to Social Surroundings guidance to reduce duplication ~ New cumulative impact guidance ~ New and holistic impact guidance - Seeking to set Outcomes-based Conditions AES aims to stay up-to-date with environmental approvals and compliance requirements for WA projects.

BREAKING NEWS: Massachusetts DEP Denies Holtec Permit The Massachusetts Department of Environmental Protection denied Holtec’s application today to use Cape Cod Bay as a dumping ground for industrial wastewater. The DEP decision closely follows the legal framework Association to Preserve Cape Cod (APCC) developed that clearly articulated how the Massachusetts Ocean Sanctuaries Act required that Holtec's discharge permit application be denied. Stopping the use of Cape Cod Bay as a cheap dumping ground for Holtec’s waste is a validation that local voices and concerns matter. These victories do not come cheaply or easily. A well-resourced multinational corporation, Holtec is used to getting its way by claiming that federal rules disempower local and state authorities. Holtec's practice is to steamroll local discretion, and it took APCC to stand up and resist. APCC, through the generosity of our members and supporters, was able to hire the very best legal team to build the case against Holtec. As gratify as this decision is, APCC is not done yet. Holtec is on record that they will appeal so APCC cannot and will not stand down. APCC and their legal team will support the DEP ruling against whatever appeals Holtec files. That means they need your support to finance what will be another expensive effort to protect Cape Cod Bay. Recent shifts in environmental and energy law in the U.S. are set to significantly impact the legal job market. As regulatory landscapes evolve, demand for legal professionals with specialized knowledge in energy policy, environmental regulation, and administrative law is expected to rise. See below for why: Chevron Deference Overturned: The Supreme Court's decision in Loper Bright Enterprises v. Raimondo ended Chevron deference, shifting power from federal agencies to courts in interpreting environmental laws, potentially making it harder to enforce regulations (CIEL). FERC Order 1920: This new order by the Federal Energy Regulatory Commission aims to modernize the U.S. energy grid, enhancing planning, transparency, and adoption of grid-enhancing technologies to support renewable energy integration (American Bar Association). ADVANCE Act: Signed into law in July 2024, this bipartisan act supports nuclear energy by reducing regulatory barriers and promoting advanced technologies to help reduce emissions and boost energy security (EnviroWorks).

Yes, the current issue of Energy Today, has been posted early. Energy In Place https://lnkd.in/gBw3Tv8v "All-of-the-above" is a dominant energy theme, and it has many advocates, in part because the concept embraces the full spectrum of available resources: clean sources like #wind, #solar, #hydropower, #biofuel, and #nuclear, as well as #oil, #naturalgas, and sometimes #coal too. But, even though the concept offers consensus, it is not always realistic. An #energy solution that works for one community does not necessarily work for all.? No matter how inclusive or attractive the energy source, there are certain physical laws that cannot be altered, geographic barriers impossible to overcome. #Electricity must be consumed as it is produced (in other words, its expiration date is "now"). It is hubris to believe otherwise. In an extreme example, consider the energy needs of Palau, located 400 miles east of the #Philippines....

The Impact Assessment Agency of Canada released their draft report on the Boat Harbour Remediation Project on October 15, 2024. At 152 pages in length, I do recommend you pour yourself a drink (hot, cold, or a spirit!) to read. I am not Mi'kmaw so this post is not meant to speak for them, but as a fellow First Nation individual it is highly questionable why Pictou Landing First Nation is forced to have hazardous waste stored on their traditional lands and beside their traditional waters. This entire mess began from the neighbouring pulp mill and was because of environmental racism yet the proposed solution reeks of additional and new environmental racism. Build Nova Scotia has unilaterally decided to reject hauling away this hazardous waste because of transportation expense and challenge to find a suitable disposal site that could take time and/or additional cost to build. BUT the kicker I read was an over reliance on claiming it is unsafe to truck this hazardous waste away in the event of accidents/spills. Yet we have the Nuclear Waste Management Organization planning to haul nuclear waste much further and for a 50 year period: "Today, Canada’s interim facilities to manage used nuclear fuel are located at nuclear reactor sites in Ontario, Quebec, and New Brunswick, and at Atomic Energy of Canada Limited’s sites in Manitoba and Chalk River Laboratories in Ontario. Site selection for the deep geological repository is on track for 2024. Two potential siting areas remain in the community-driven process: the South Bruce area in southern Ontario in the traditional territory of the Saugeen Ojibway Nation, and the Ignace area in northwestern Ontario in the traditional territory of the Wabigoon Lake Ojibway Nation. Transportation from interim storage to the repository will involve road transportation, or a combination of road and rail, depending on which site is selected. Transportation will occur using predominantly existing infrastructure and will take approximately 50 years to transport, depending on the inventory of used fuel to be managed." So Build Nova Scotia is claiming they cannot truck away a far less hazardous waste from Pictou Landing First Nation because of safety concerns yet the Canadian public is safe for 50 years worth of long haul transportation of nuclear waste? Last week, Dunsky Energy + Climate Advisors held their final of six workshops covering Canadian <> EU Dialogues on Methane. The workshop focused on the recent European Union Methane Regulation and Import Requirement agreement, that will require stringent Measurement, Reporting Verification (#MRV) for both domestic production and international imports of oil and gas into the EU. Diving into the rule, countries importing into the EU will have the following two pathways to demonstrate MRV equivalence (ref: Article 27a) ? a) THE PRODUCER applies monitoring and reporting measures equivalent to those set out in Article 12 OR monitoring and reporting at OGMP 2.0 level 5. ? b) THE COUNTRY adopts and implements a regulatory framework on measurement, reporting and verification requirements that are at least equivalent to that applied in the EU. During the workshop, a speaker representing the EU suggested “for now, there is not a single country that would qualify for MRV equivalence, so we are expecting to see this action at the individual level, creating a driver for strong country-level requirements in the future.” So, what does that mean for individual producers? Audit our detection sensitivity achieved in the field for every site we scan under any condition in any basin. The method has now been validated with thousands of controlled releases. Instead of only testing under ideal conditions that aren’t representative of the field, we have embraced all conditions to confidently assess our actual performance. Think peace of mind for #EPA compliance. 2. Accurately and methodically determine the emitters that we *don’t* detect (i.e. below our 100% probability). Our detection sensitivity is unparalleled, but all of us still need to continually ask “what did we miss?” Think confidence in hitting your corporate methane intensity goals. 3. Remove critical systematic error from emissions inventories.
