It was a pleasure presenting on dispute resolution and arbitration to building professionals in our construction industry at the Barbados Association of Professional Engineers monthly webinar. In addition to negotiation, parties to a dispute arising during a building project may resolve their dispute through neutral evaluation, expert determination, the use of a dispute board, mediation, adjudication and arbitration.?Arbitration is a dynamic and binding private mechanism for dispute resolution. It is conducted before an impartial tribunal and is attractive to parties because it is created solely by their agreement. It is important to ensure that a valid arbitration clause is placed in the relevant building contract to ensure that it stands ready as an effective mechanism to resolve any dispute.

This especially happens with predominant Type A personality types with their constant need to prove themselves. But this process is such an energy and confidence drainer, resulting in negative impact on productivity. (All the more in environments where initial period sets the perspective etched in stone) There are solutions to this situation: 1. Reducing weightage on external validation as this will focus you on things that are in your influence rather than things that are not. (One cannot please everyone, right people will see your worth anyway) 2. Constant reminders of your achievements because of which you are at a coveted position. This will help to cope with Imposter Syndrome 3. Reducing the perfectionism and being comfortable with failing fast, seeking feedback and moving ahead.

I'm sure many of you can relate to the scenario Simon Sinek discusses. It's becoming more common now for companies to take it a step further by putting new hires on a third-party payroll contract for the first 6 months or even a year.
