Love her or hate her, Meghan Markle is having a hard time with the United States Patent and Trademark Office (USPTO). The Duchess has been trying to obtain federal registration for her new lifestyle brand, American Riviera Orchard. But among the issues she’s run into is this argument: The name has a geographical component. Geographical marks have been historically problematic because they imply that the product (or service) in question represents the geographical area listed in their name. And adding the word “orchard” to the name isn’t enough to negate the geographical issue.
