Ensuring Quality in Procurement Contracts When it comes to procurement contracts, ensuring non-contractible quality (NCQ) can be a challenge. To address this, buyers can use various tactics within contract execution, such as: Rewards and Penalties Introducing bonuses or penalties based on observed quality can discipline contractors to provide NCQ. Contract Termination Threatening early unilateral contract termination can motivate suppliers to provide NCQ, but this tactic's effectiveness depends on the cost of finding an alternative supplier. Within-Contract Competition Keeping the possibility of switching to different suppliers within contract execution can pressure contractors to provide desirable NCQ levels. Switching to Lower-Ranked Offers Switching directly to the second-best supplier selected in the initial competition can save time and avoid new competition costs. Procurement Derogation, Single Supplier Exemption, Direct Award Requirement... Whilst the names used by authorities might differ, the objective is the same. Award a contract without running a competitive tender process. They are a necessity to run a successful procurement function, however they currently lack full transparency (unless you are publishing a VEAT, a Contract Modification notice, or a Contract Award notice). There are many provisions of the Procurement Act which (for me) are a big step in the right direction, none more so than the tighter controls put around the direct award procedure. Big fan of the attached 'Direct Award Justification Report', and another new reporting requirement that should be on the radar of every contracting authority. #procurementact #directaward

At last... Procurement Act 2023 – go-live date confirmed ?? The government has just confirmed it is working towards a go-live date of 28 October 2024.?This will be formalised in regulations due to be issued in May.?If this all goes to plan then procurements started before 28 October 2024 will be governed by the current Regulations, and any started on or after 28 Oct 2024 will be governed by the Procurement Act 2023.??In most instances, started or commenced means that a contract notice has been submitted.?In respect of direct awards (so where the procurement is not publicly advertised), this time will start when a contracting authority has contacted a supplier with the intention of entering into a contract... More to come, so watch this space. One of the key changes introduced by the Procurement Act 2023 (PA), when it comes into force on February 24, 2025, is that the entire contract lifecycle will be within scope. "Contract managers will need to ensure that they are aware of the new requirements under the PA but also the opportunities to use these changes to improve contract performance across their authority."
