Alan C. Horowitz, Esq. will co-present, along with Dr. Karl Steinberg, at the?American Health Law Association’s (AHLA) 2024 Long-Term and Post-Acute Care Law and Compliance Conference in San Diego, California on February 26-28, 2024. The presentation “Respecting Patient Autonomy: Legal and Medical Aspects of End-of-Life Care” will focus on the legal and medical aspects of Medical Aid in Dying (MAID), Voluntary Stopping Eating and Drinking (VSED) and Stop Eating and Drinking by Advance Directive (SED by AD).?Dr. Steinberg will address clinical issues from the perspective of a medical director, and Alan will discuss the legal aspects, including Supreme Court and appellate court decisions. Current and pending legislative initiatives will be explored. Additionally, related claims of wrongful life, wrongful death, survey deficiencies, and medical malpractice will be discussed along with the increasing trend in lawsuits against health care providers. https://lnkd.in/ejcJDdyG

Healthcare Alert: In a lawsuit by former members of a multi-specialty practice, the former members sought an order from the court that would have voided the restrictive covenants in the practice’s operating agreement and allowed them to essentially spin off a whole department from the practice to operate it as their own. Aside from making common assertions of unreasonableness and adverse impact on patient care in support of their desired relief, the plaintiffs claimed that they were never members of the practice, despite their signing its operating agreement, based on a certain technicality and the allegation that they were not treated as members.?After months of litigation, three court hearings, and multiple opportunities for plaintiffs to supplement the record and modify their desired relief, the court denied the plaintiffs’ applications for a TRO and a preliminary injunction, which effectively preserved the practice’s right to enforce its restrictive covenants.? ?
