As a career Marine who served at Camp Lejeune and was diagnosed with a form of blood cancer due to the base's toxic water, I, like many other victims, have faced challenges seeking justice and compensation under the Camp Lejeune Justice Act (CLJA) without an attorney. Troubling disparities exist between those with and without legal representation. ? Non-represented claimants miss out on crucial information shared with those who have legal representation, receiving only generic correspondence. Attorneys representing claimants are involved in discussions and negotiations with the government that non-represented claimants are not privy to. These attorneys might make decisions or reach agreements that set precedents or influence the overall handling of claims, potentially impacting the chances of non-represented claimants getting fair settlements. Since these attorneys primarily focus on their clients, there might be conflicts of interest where decisions benefit represented claimants more, leaving non-represented claimants at a disadvantage without their input or consideration. ? Furthermore, claims from those with legal representation are often prioritized over those without. The government has expedited certain cases for settlement offers while non-represented claimants wait. The Elective Option, intended to expedite settlements, is too restrictive, excluding most claimants due to its narrow criteria. ? Inadequate funding and resources further hinder the claim process. The Navy's Tort Claims Unit struggles to review the overwhelming number of claims while technical issues slow progress. Increased funding and streamlined processes are vital for providing timely relief to all claimants. ? To date, only a tiny fraction of the 227,309 administrative claims have been processed. The Navy must prioritize non-represented claims equally, ensuring all affected individuals have a fair chance at justice and compensation. ? I urge the government to address these disparities by increasing funding and staffing, streamlining access to records, expanding Elective Option criteria, and appointing a liaison for non-represented claimants. ?
