The Federal Government has just received the Report of the Independent review of the National Legal Assistance Partnership review led by eminent person, Dr Warren Mundy. We call on the Government to publish the report and commit to fully implementing the recommendations. DjirraVIC, like other Aboriginal-led Family Violence Prevention and Legal Services (FVPLSs), is the lowest funded of the four legal assistance providers in the country. 97% of our staff are women, we have more female Aboriginal staff than any other legal assistance provider in Victoria, and we do not have pay parity. More than 97% of people reaching out for our specialist family violence services are Aboriginal women and their children. The Government must invest in the FVPLS sector. We must have: 1?? Equal pay with other legal assistance providers. 2?? Quarantined funds including a dedicated funding stream within Department of Social Services to fund our holistic non legal support work. 3?? Longer term funding certainty – 5 years or more – with indexation. 4?? Increased funding to ensure that Aboriginal people experiencing family violence have equal access to holistic, culturally safe legal and non-legal help no matter where they live in the country. 5?? Reallocation of funding from mainstream legal services to Aboriginal community-controlled legal services. Aboriginal people deserve access to culturally safe legal and non-legal services. Our profession is calling on all governments to significantly increase their support for Australia’s legal assistance sector. Our legal assistance sector – Legal Aid Commissions, Community Legal Centres, Aboriginal and Torres Strait Islander Legal Services and Family Violence Prevention Legal Services – is designed to be there for members of our community during times of life when they experience significant vulnerability, need, hardship and stress. On a daily basis, these services are relied upon by people who may be experiencing family violence, elder abuse or are at risk of homelessness. However, our legal assistance sector has suffered greatly under decades of funding neglect and cannot keep up with demand for services. It is a sector in crisis. On 28 May 2024, the Final Report of the Independent Review of the National Legal Assistance Partnership was released. This Report is a thorough investigation into the legal assistance landscape and provides clear guidance for how access to justice in Australia can be dramatically improved. Stronger Legal Aid for a Better Legal System' including an injection of funding into Community Legal Centre’s is vital as everyone is entitled to accessible; affordable and equitable legal services and denying justice to Australia’s most disadvantaged people and people who cannot generally afford a legal service is at breaking point. Scottish lawyers begin industrial action amid legal aid reforms Lawyers across Scotland have begun industrial action in response to pressure on the legal system and concerns that the profession is at "breaking point." Around 800 criminal defence solicitors are boycotting cases prosecuted under the Scottish Government's domestic abuse legislation, as well as refusing to act where an accused has no solicitor and cannot represent themselves. The Scottish Solicitors Bar Association (SSBA) is behind the action and has warned that if ministers do not respond positively, they will escalate disruption to court business. The dispute centres around the level of pay for criminal defence lawyers through the legal aid system and how rates are reviewed. The last round of industrial action ended when the previous justice minister agreed to a 10% increase in fees, but the SSBA argues that this was cancelled out by inflation and that the annual review has not progressed. The action is expected to last for several weeks and is taking place ahead of the general election.
