Cable Companies Ask 5th Circuit To Block FTC's Click-to-Cancel Rule: Cable companies, advertising firms, and newspapers are asking courts to block a federal "click-to-cancel" rule that would force businesses to make it easier for consumers to cancel services. From a report: Lawsuits were filed yesterday, about a week after the Federal Trade Commission approved a rule that "requires sellers to provide consumers with simple cancellation mechanisms to immediately halt all recurring charges." Cable lobby group NCTA-The Internet & Television Association and the Interactive Advertising Bureau trade group sued the FTC in the conservative US Court of Appeals for the 5th Circuit. The lawsuit claims the 5th Circuit is a proper venue because a third plaintiff, the Electronic Security Association, has its principal offices in Dallas. Mobile phone and broadband companies EE, BT, Talk Talk, Plus Net, Virgin Media and Telefonica have had their adverts banned by the Advertising Standard’s Authority (“ASA”). The ASA found the advertisements of these providers were misleading in breach of the Code of Advertising Practice as they failed to clearly and prominently notify the customer of mid-contract price increases. The providers advertised the product packages with a headline price but failed to prominently and clearly advertise the fact that the price would be subject to a price increase in April 2025. The issue was that they failed to give the price increase information prominence because it was placed in text that was away from the headline price and only indicated by asterisks or other links that needed to be clicked. Effectively, the consumer could have missed this information which would have deprived them from making an informed decision. It shows the increasing importance of underscoring material information to consumers otherwise the advertisement could be both misleading and unfair within the meaning of the Consumer Protection from Unfair Trading Regulations 2008 (soon to be under the Digital Markets, Competition & Consumer Act 2024).

The U.S. Chamber of Commerce launched an advertising program last week regarding a pattern of regulatory overreach in the broadband marketplace by the Biden administration. A new 30-second ad calls on the White House to "focus on closing the digital divide, not harmful government micromanagement that undermines public and private sector broadband investments." ? "'Trying to regulate modern broadband and 5G high-speed networks like the early days of the telephone is a disservice to Americans,' said Neil Bradley, Executive Vice President, Chief Policy Officer, and Head of Strategic Advocacy at the U.S. Chamber of Commerce. 'The regulatory onslaught from the FCC is an attempt to resurrect failed Internet price controls and the public utility-style policies of the 1930s — hindering efforts to bridge the digital divide.
