Courts in U.S. battleground states are taking proactive measures to swiftly decide election cases, aiming to prevent prolonged disputes that could impact the election results. Arizona's court system recently implemented special procedures to expedite election litigation, emphasizing the significance of timely resolution in a presidential election. The state's supreme court issued an order directing trial court judges to prioritize lawsuits related to the 2024 election, including matters such as vote recounts and the selection of presidential electors. These efforts underscore the importance of ensuring a timely and efficient electoral process. #USPolitics #ElectionLitigation #ArizonaSupremeCourt https://lnkd.in/ggR2yYs7

If Trump wins the election:? The takeaways? It would mean the Supreme Court has judged that a POTUS is above the law. Therefore free to campaign unhindered. And that he would be empowered to literally do anything, even ordering the elimination of critical persons, if he were so to choose. And be legally empowered to do so without recourse. He could also work to change the constitution? Work to imprison competitive politicians or their sponsors. Almost a copy book from Putin? Add further Supreme Court people when the opportunity arises.

DEVELOPING - Trump DC trial before election: As I reported yesterday, Judge Tanya S. Chutkan today scheduled a hearing for August 16 in Washington to discuss the next steps in former President Donald J. Trump’s federal election interference case. Today is August 3, 2024, that’s in 13 days. NOTE: At the hearing, Judge Chutkan will confer with Trump’s lawyers and prosecutors from Special Counsel Jack Smith’s office to outline how to proceed with the fact-finding mission ordered by the Supreme Court. NOTE: The pre-trial follows the Court’s ruling granting former presidents broad immunity against criminal prosecution for official acts. NOTE: Judge Chutkan will need to review the 45-page indictment, distinguishing which allegations can proceed to trial and which must be dismissed as protected presidential acts. NOTE: What is likely to happen, as I noted yesterday, is that the judge will allow oral arguments to determine what is protected by the Supreme Court ruling and what is not. This could enable Jack Smith to call a significant number of witnesses, effectively turning the pre-trial proceedings into a trial before the election, and potentially even permitting cameras in the courtroom.

WHITE PAPER: A “zombie lawsuit” is a case that — by design — has no chance of succeeding before the election but serves as a pretext to overrule the voters afterwards. Counsel John Paredes explains why using these suits to challenge election results will fail. https://lnkd.in/ehgsb7yG John explains: “no procedural alchemy can turn election deniers’ nuisance lawsuits into successful election challenges.” Nevertheless these suits are not harmless. They deceive the public, disrupt our election processes, and undermine confidence in election-integrity, providing a pretext to deny the results.

"Unprecedented election power" granted to NY AG, Lettia James. Beginning September 22nd, AG James will have unchecked legal power to oversee some 25 plus or minus local jurisdictions in the State of NY. The law, which passed in 2022, calls for the AG to oversee various local jurisdictions that under the new law are labeled a "covered entity," and thereby subject to "preclearance" oversight by the AG's office. Need we even go down this road?! If it smells like a rat, it most likely is! And this definitely smells like one. Just another way the NY Democratic Party is trying to control the outcome of an election, or at the very least nudge it in the direction of their party preferences. #lettiajames #newyorkattorneygeneral #preclearance #votingrights #democraticparty
