There are many ways we can help people experiencing homelessness. Fining or jailing those who sleep outside is not one of them. As Camilla Krauss, an attorney with the Chicago Coalition for the Homeless, says in the article, "Solution-driven approaches are more effective...these punitive approaches really don't do anything to solve homelessness." Homelessness is a choice many in this lucky country are being forced to make. I don't know about you, but I feel it is downright #UnAustralian to look the other way. Not just Social Sector Organisations and Peak Bodies, we should all be lobbying Government as concerned citizens that legislation should be drafted in support of the basic human right to have somewhere to call home. The rough sleepers that far too many believe is the Homelessness problem need to be made aware, that is the end result for far too many who just need a helping hand, a hand up, as to not having their only choice be to become homeless. The Great Australian Dream is coming crashing down for far too many and with the #CostOfLivingCrisis and #HousingAffordabilityCrisis being driven by the Haves........ the Have Not's are forced into Survival mode and whatever it takes. It's about housing.

The majority opinion stated that "Homelessness is complex...Its causes are many.... People will disagree over which policy responses are best..." The Court held that regulating and removing people who camp or sleep on public property does not amount to cruel and unusual punishment under the Eighth Amendment to the U.S. Constitution. In a dissent, Justice Sotomayor said, "Sleep is a biological necessity, not a crime", and "[f]or some people, sleeping outside is their only option." She asserted that the city (of Grants Pass, Oregon) "punishes them for being homeless." It was a 6-3 decision. The attached journalistic discussion of the decision and the dissent is superb, and includes quotes from the decision, some data on homelessness, and reactions. One such pragmatic reaction was from Cassy Leach, who founded the Mobile Integrative Navigation Team. She said, "Homelessness isn't going away. It's only going to continue to skyrocket... We...need to solve for it..." The reality is that homeless individuals should not be penalized - in any way - where they have no other alternatives. Moreover, and for certain, States, counties, cities, and all communities must - at a minimum - do more to provide safe and secure shelter for their homeless citizens. #affordablehousingcrisis #homelessness #homelesscamping #SCOTUS #needforshelter

The Supreme Court recently heard arguments in #GrantsPassVJohnson, the most important case impacting homelessness of the past 40 years. The case will determine whether arresting, fining, ticketing, or otherwise punishing people for sleeping outdoors on public property when they have nowhere else to go violates the Eighth Amendment of the U.S. Constitution, which prohibits excessive bail, fines, and cruel and unusual punishments. Domestic violence is a leading cause of homelessness. Many survivors flee their homes to escape violence. But safe, affordable housing is extremely limited, often forcing them to make impossible choices between sleeping outside or suffering continued violence. Housing is safety for survivors. The UK Government's proposed Criminal Justice Bill threatens to criminalise homelessness, imposing fines up to ￡2,500 on individuals who are simply trying to survive on the streets. Homelessness is not a choice. It's often the result of systemic failures, such as poverty, family breakdowns, or sudden job loss due to illness. Yet, instead of addressing the root causes and providing support, this bill seeks to punish those already facing immense challenges. As a St Mungo's worker, I am committed to ending homelessness, I strongly oppose the criminalisation of those experiencing homelessness. No one should fear prosecution simply for seeking shelter or a place to rest. Homelessness could happen to any of us. Life is unpredictable, and circumstances can change in an instant.
