Love her or hate her, Meghan Markle is having a hard time with the United States Patent and Trademark Office (USPTO). The Duchess has been trying to obtain federal registration for her new lifestyle brand, American Riviera Orchard. But among the issues she’s run into is this argument: The name has a geographical component. Geographical marks have been historically problematic because they imply that the product (or service) in question represents the geographical area listed in their name. And adding the word “orchard” to the name isn’t enough to negate the geographical issue. “I’ll just take them to court and sue the pants off them!” That might be your initial reaction to finding out someone has infringed on your registered trademark rights. But before you take someone to court over trademark infringement, there are a few things you should know… 1. Recent studies show the cost of trademark litigation (if it goes all the way through trial) can be upwards of $500,000. 2. Those costs *will* likely be even higher. 3. Litigation can take over a year. It might feel good to stick it to the trademark copycat. But you have a lot of other options before it gets to the “sue the pants off them” stage.
