Are in-house lawyers inevitably ethically compromised? I don't think so. But I realised today that there are 2 days left for (England & Wales) in-house counsel to respond to the University of Leeds and Law Society's survey "Ethical Practice Framework for In-house Solicitors". Filling in the survey was really thought-provoking. I've been thinking about writing more on this subject, but it's a big topic. My two major controversial exploratory thoughts triggered by this survey are: ?? to reduce risk of compromise, should in-house legal teams have privilege only when their reporting line carries through a GC, who themselves acts as a board member? ???? from an "uphold the rule of law" angle, should there be much stricter focus on condemning advice that crosses from "this is likely to be seen as unlawful" to "it's unlawful, but risk of discovery / material punishment is low". I'm not sure what I think on these points. And I'm not saying all in-house are Dr Gonzo... Thoughts? I would love to hear perspective of others - whether in comments below or by DM, and whether on my two thoughts above or on the general question. Although if you have only fifteen minutes to think about this, don't comment here - fill in the survey!
