Representative Jackson Lee was a formidable force in the fight for social justice, and her legislative accomplishments reflect her deep commitment to creating a fairer and more equitable society. She was a vocal supporter of initiatives aimed at ending domestic violence, protecting reproductive rights, and promoting educational opportunities for all. JWI worked closely with Congresswoman Jackson Lee on the 2022 reauthorization of the Violence Against Women Act as well as other important legislation to support victims and survivors of gender-based violence. Co-authored with Anwesha Ghosh and Tejaswini Tripathy, this chapter delves into the complex landscape of abortion policies following the reversal of Roe v. Wade in the Dobbs v. Jackson Women's Health Organization decision. Employing Carol Bacchi's "What’s the Problem Represented to Be?" framework, we critically analyze the conflicting representations of human rights in abortion discourse: 1. "Rights of unborn children" in abortion bans. 2. "Women’s equal rights" in human rights debates. Our findings reveal that both perspectives perpetuate nuanced inequalities, calling for a comprehensive and equitable framework to ensure women's access to their rights.

Two weeks ago, the European Commission published its latest Rule of Law Report for EU member states. As part of the ASTRA Network, Foundation for Women and Family Planning (FEDERA) contributed to this report alongside our partners from Kampania Przeciw Homofobii (KPH), International Planned Parenthood Federation (IPPF), the Center for Reproductive Rights, and ILGA-Europe. The European Commission acknowledges positive developments in Poland, such as the absence of major threats to the rule of law, justifying the recent closure of the infringement procedure. However, it also highlights ongoing issues, such as SLAPP (Strategic Lawsuits Against Public Participation) against journalists, that require attention. What does the rule of law have to do with reproductive rights? We believe the rule of law crisis must be examined from a women's rights perspective. Issues like duplicate judges or the neoKRS affect more than just a few lawyers. A poorly constituted Constitutional Tribunal, for instance, banned abortion due to fetal defects. We cannot claim to uphold the rule of law while maintaining regulations that violate international standards, such as criminalizing abortion, or when doctors unlawfully refuse to perform abortions despite rulings from the Strasbourg Tribunal. Together with KPH and other organizations, we have urged the European Commission to recognize that violations of reproductive and LGBT+ rights stem from a rule of law deficit.
