New success before the Supreme Court for the @PwCTLS TCDR team on Italy-United Arab Emirates (UAE) tax issues A significant win was obtained together with my colleague @MaurizioFoti before the Supreme Court, which recognized our client (an instructor pilot of the Frecce Tricolori of the Air Force) the right to refund of the personal income tax paid in Italy on income received by the Government of the UAE during the period in which the taxpayer, tax resident in Italy, was seconded to the UAE to carry out training activities for the UAE Acrobatic Team. Specifically, the Supreme Court, with recent ruling no. 22585/2024, confirmed the following principles of law: Article 19, paragraph 1, letter a) of the Italy-UAE tax treaty attributes exclusive taxation rights to the State of the source of the income (UAE) by virtue of the literal text of the provision, which uses the expression "is taxable only in the State", thus requiring a textual interpretation pursuant to Article 31, paragraph 1, of the Vienna Convention on the Law of Treaties of 23 May 1969; The Italian State is therefore not authorized to exercise its right to tax income from the UAE, having renounced it from the outset with the signing of the Italy-UAE tax treaty; The absence of a personal income tax in the UAE is irrelevant.

NATO and the Cold War The US formed NATO with Britain, France, Italy, Belgium, Canada, Denmark, Iceland, Luxembourg, the Netherlands, Norway, and Iceland in 1949. NATO was a classic military alliance where “an armed attack against one or more” of its members “shall be considered an attack against them all.” The threat of the “use of armed force” in retaliation for such an attack served as the deterrent against aggression. The 1955 Warsaw Pact was the Soviet Union’s direct response to NATO. The Soviet military alliance included Albania, Bulgaria, Czechoslovakia, East Germany, Hungary, Poland, and Romania. It asserted that “the North Atlantic bloc increases the threat of another war and creates a menace to the national security of the peace-loving states.” Forty years after the Great War, the world once again found itself in the throes of a sensitive balance-of-power between two alliances depending upon military deterrence to prevent a catastrophic total war. #diplomatichistory
