In today's complex business environment, understanding how to effectively manage corporate investigations is crucial. That’s why it was such a treat to learn from Tannenbaum Helpern Syracuse & Hirschtritt LLP partners Paul Sarkozi,?Daniel Horwitz?and?Amanda Leone, and Polaris Corporate Risk Management principals?Steve Ward?and?Laura Bolger,?who led an interactive and informative CLE panel and discussion of the critical elements to securing the best possible results in investigations and contentious matters for In-House Counsel. Key takeaways included: 1. Begin with a clear decision tree to assess potential civil claims and liabilities. Always consider reputational risks and the implications of litigation. 2. A strong defense starts with a good offense. Collect comprehensive data and understand the nature of any allegations, whether they involve fraud or other liabilities. 3. Review your insurance coverage to ensure it supports potential investigations. Understand the financial implications and manage legal budgets effectively. 4. In the digital age, preserving electronic data is critical. Implement a robust process to lock down and control information flow to prevent spoliation. 5. Establish a well-defined process for data collection and investigation. This builds trust with third parties, whether in litigation or regulatory contexts. 6. Maintain clear communication channels and protect privileged information. Ensure all parties understand the importance of confidentiality. 7. Be prepared to adjust your strategy as new information emerges. This includes identifying new custodians and understanding broader implications. Following the panel, we had a wonderful networking reception! Thanks again to Tannenbaum Helpern and Polaris Risk for making this wonderful evening possible! And thanks to all the In-House Connect members who attended!

Given the geopolitical, regulatory, and business climates, corporate leaders want to enhance the operational and strategic maturity of their corporate investigations. 2025 will be critical for many industries, and corporate litigation and investigation leaders will be required to rise to the challenge.
