Art Unit 1718 examines patent applications directed to coating and etching processes, technology important for semiconductor and chip manufacturing. The semiconductor and chip manufacturing technologies are of utmost geo-political importance these days. AU1718 exhibits a wide range of patent examiner allowance rates, ranging from 3% to 69%. Chart A shows that German-owned patent applications are predominantly to the examiner who only allows 3% of the cases. Why are 92% of Atotech GmbH's applications in AU1718 assigned to the 3% examiner? Why are 82% of the United Tech Corp and 67% of GE's applications filed in AU1718 assigned to the 3% examiner? Chart B shows examples of other American, plus Taiwan, Korean, Japanese, and Dutch owned companies whose patent applications filed in AU1718 are NOT predominately assigned to the 3% examiner. 48% of Taiwan Semiconductor applications are assigned to an examiner with a 43% allowance rate. None of Taiwan Semiconductor's applications are assigned to the 3% examiner. Expedited patent examination for semiconductor technology "To encourage research, development, and innovation in semiconductor manufacturing, the Commerce Department’s U.S. Patent and Trademark Office (USPTO) is?announcing?a new?Semiconductor Technology Pilot Program?developed to support the CHIPS for America program. #uspto announced Semiconductor Technology Pilot Program which will run until December 2, 2024 or date on which total of 1000 applications have been granted special leave status which ever occurs earlier. ? The program is intended to provide equitable intellectual property protection to incentivize investment in #semiconductor manufacturing space. ? The program will expedite examination of #patent applications for innovations that increase semiconductor device production, reduce semiconductor manufacturing costs, strengthen the semiconductor supply chain. ? Eligible patent applications must contain at least one claim that covers a process or an apparatus for manufacturing a semiconductor device and that corresponds to one or more of the technical concepts within H10 or H10L in the CPC system. ? Eligible patent applications include i) Non-continuing original utility nonprovisional applications; and ii) Original utility nonprovisional applications that claim the benefit of the filing date under 35 U.S.C. 120, 121, 365(c), or 386(c) of only one prior application that is either a nonprovisional application or an international application designating the United States. ? Applicants must file the petition to make special with the application or entry into the national stage under 35 U.S.C. 371 or within 30 days of the filing date or entry date of the application. ? The fee for the petition to make special under 37 CFR 1.102(d) has been waived for this program. M&A is an interesting topic, in every strategy/case study we know hindsight is 20/20 so it is easier to analyze the situation after the fact !!. How ever in my years of experience working at startups, there is one common theme that comes across: in a market that is "frothy," i.e. is the flavor of the day such as Telecom, AI or other, M&A activity is driven by what the stock market drives it to be. It is purely based on short term strategy. Not anything long term or something that can be monetized. So, to all my friends at #Intel, Pat Gelsinger is the right person to lead #Intel. He came from the old Intel and knows strategy, technology, engineering very well (Having led it's GPU efforts). Intel made acquisitions such as Nervana Systems that was a dud.....and spent a lot of money trying to monetize the technology. But lack of a cohesive strategy and trying to get vertically integrated (which is the right thing to do to extract efficiencies) Why I say this, is as follows, not just because it concerns me personally, but in general, #Intel et. al spent millions of dollars to fight the patent lawsuit on https://lnkd.in/gqNiwnR4 It would have been a lot cheaper for #Intel to settle this case and given it the time to build a stronger approach to system level solutions instead of piece meal stitching together stuff. #Nvidia acquisition of Mellanox was very apt, leading to NVLink interconnects. Nvidia and AMD licensed patent #6009488 and used it to their advantage in their business dealings. AMD 's acquisition of pure software solutions to vertically integrate is not being frowned upon by the market. It is critical to get rid of NIH, EGO and focus on making the company successful. Intel is too important for the US industry to fail! Wishing the #Intel management team the best of luck.
