Very honored to have my observations on the impact of the Supreme Court ruling overturning Chevron quoted in the Washington Post. While the Loper decision affirms that interpretations of ambiguous federal statutes are ultimately within the purview of the courts, federal agencies will continue to be given deference to their findings of fact. Further, Loper does not address deference to how agencies interpret their own regulations. This still leaves a lot within a federal agency's authority for which timely and meaningful judicial review will remain difficult -- for example EPA's sea-changing reevaluations of chemical risks (like IRIS values) and its aggressive launching of national enforcement initiatives based on entirely new reinterpretation of decades-old regulations (like the Benzene Waste Operations NESHAP). Loper also does not require a judge to reject an agency's interpretation of an ambiguous statute. A judge can agree that the agency's interpretation is permissible. And when a judge does disagree with an agency's interpretation of a statute, the judge might not necessarily disagree in a way that curtails agency authority. Finally, how courts should address questions of mixed law and fact remains uncertain. The impacts of Loper will be far-reaching to be sure, but many questions about how this will play out remain and a great deal of agency regulatory authority remains in tact.

Ensuring environmental safety is a key priority in our drilling operations. Today, our team collected drill mud samples for laboratory analysis, a crucial step in identifying and managing potentially hazardous chemicals. These mud can contain harmful substances such as barium sulphate and base oil(hydrocarbon) that pose a risk to the environment if not properly handled. To enhance our analysis, we leverage the retort machine, which allows us to precisely measure the volume of base oil and water content within the drill mud. This data is essential before the cuttings are sent for treatment in the thermal desorption unit, where contaminants are safely removed. Through these meticulous processes, we not only safeguard the environment but also uphold the highest standards of operational excellence. Project Spotlight We recently wrapped up a project that showcased the expertise and dedication of the Defend Environmental team. A client reached out to us because they had previously worked with Chad Pilon. They knew his on-site leadership and meticulous attention to detail would ensure the job was completed safely and efficiently. We ensured successful neutralization and removal of sulphuric acid from a tank in need of maintenance, then safe return of the acid to the holding tank when repairs were completed. Our team ensured this project was executed with precision, ensuring minimal disruption and maximum safety throughout the process. Why did they choose Defend Environmental?
