On 11/15, a federal court struck down the exempt salary threshold changes on a nationwide basis, voiding both the previous July 1 ($43,888) and upcoming Jan 1 ($58,656) salary threshold requirements. While I expect more court activity, I don't expect the incoming administration to be in favor of salary threshold increases. For now, you can put those changes on hold.

Keep track of what transpires around this between now and January 1st, 2025. This is expected to be challenged specifically around or after the election. Here is a breakdown: Under the final rule, the salary threshold for executive, administrative and professional employees will jump from the current level of $684 per week ($35,568 per year) to $844 per week ($43,888 annually) on July 1, and to $1,128 per week ($58,656 annually) on January 1, 2025. These new salary thresholds are even higher than those proposed by the Department of Labor in its August 2023 Notice of Proposed Rulemaking. The final rule does not change the requirements for other exemptions under the FLSA.

On April 23, the U.S. Department of Labor published its long-awaited final rule (“Final Rule”) that will update the salary thresholds for “white-collar” exemptions (e.g., executive, administrative, professional, outside sale, and computer employees) and highly compensated employees. In short, the Final Rule increases the base salary level required to qualify for the payment of an exempt salary by more than 20 percent, with that amount to increase further by January 2025 and thereafter.?Learn more at:?https://lnkd.in/djzxBgNE

On April 26, 2024, the U.S. Department of Labor (DOL) published the much-anticipated final rule that will increase the minimum salary for many exempt employees. The increase will take effect in two steps: 1?? Effective July 1, 2024, the salary threshold will increase to the equivalent of an annual salary of $43,888; and 2?? The consensus among most of my colleagues is the that first increase under the new DOL Wage and Hour regs will become effective as scheduled on July 1, 2024. You need to be ready. That amount follows the methodology of the prior increase under President Trump. There is less certainty with the January 1, 2025, increase etc. since it is a different methodology. It is also a good time to review your job descriptions for exempt employees to make sure they accurately reflect their job duties and are properly classified (including application of the new salary increase). If applicable, make sure that the description includes the requirement that they need to make independent decisions.
