In the wake of Vice President Kamala Harris's ascension as the presumptive nominee for the Democratic Party, the Howard University Initiative on Public Opinion conducted a poll on the opinions of Black voters July 22-24 in relation to Harris's candidacy. The report includes results from more than 2000 respondents from more than 30 states, weighted by gender and education level. Results suggest that Harris is best known for her advocacy for reproductive rights, that her best path to victory is to select a white male running mate, and that respondents view her as a politically moderate Democrat. By tomorrow night, the campaign for Prop 1 (the NYS Equal Rights Amendment) will come to a close as the last New Yorkers cast their vote. We have the chance to make sure our reproductive rights, including abortion, are permanently protected here in New York. We can close loopholes in the state constitution to make sure that no New Yorker can be discriminated against by the government, regardless of gender, age, ethnicity, pregnancy status, disability status, or whether someone is LGBT. Leading Ob-Gyn organizations in the US are urging the Biden administration to take immediate action to publish the Equal Rights Amendment, recognizing that the Dobbs decision and its aftermath has been possible in part because our Constitution does not explicitly recognize equality on the basis of sex. Post Dobbs, some states (like California and Michigan) have added explicit reproductive rights protections to their state constitutions, while other state courts (for example Kansas and Montana) have recognized an implicit right to abortion in constitutional provisions protecting liberty, privacy etc. This is so important! But the opposite is happening in other states - for example, Florida, where conservative justices have found no right to abortion in the state Constitution, overturning previous precedent. It's also scary that were Congress to pass a federal law restricting abortion, it would likely supersede and therefore void any state constitutional protections. That is why publishing the ERA needs to be a key part of the strategy to protect and restore access to reproductive healthcare in the United States.
