Our National President Shaun Marcus appeared before the Senate Legal and Constitutional Affairs Committee in Canberra today for its public hearing on the Costs Protection Bill 2023. The ALA considers that the modified equal access cost model as proposed in this Bill is a significant step forward for victim survivors of discrimination, including sexual harassment, at work. The status quo does not reflect the Australian public’s expectation that the justice system should offer a victim survivor access to bring a claim and to seek justice. Importantly, the Bill’s proposed model recognises and addresses the practical issues currently faced by people bringing anti-discrimination claims and supports vindication of legal rights – in particular, rights to equality and access to justice. When we elevate criminal law as the ideal solution to all harms, we empower the coercive state - not ourselves, not our communities. This should be a last resort. This is why I push so hard against the trend toward “banning all conversion practices”: there are ways to use civil law and regulations to hold institutions accountable, but in practice, the broad-based bans that we see in a growing number of states generally mean criminalizing humans and strengthening the carceral state rather than challenging and addressing root causes.

Civil rights are designed to protect individuals from unfair treatment. But they don't soley protect Black and Brown people as some may think.
