The Biden administration has advanced an ambitious regulatory agenda. Unlike in times past, the flurry of rule-making hasn't followed legislation from Congress. Biden's regulators are reinterpreting old statutes to solve for modern ills, and their proposals have been met with stiff opposition from business groups and the Supreme Court. We took a look at some data to help put the past 3.5 years of regulatory activity in context. Take a look.

Regardless of who wins the upcoming #Presidential election, #regulatoryuncertainty, #challenge, and #opportunities will continue. #CongressionalReviewAct challenges to some #BidenAdministration regulations will be upcoming if #FormerPresidentTrump wins and the #Republicans get majorities in the #House and #Senate. If either #VPHarris or #FormerPresidentTrump wins, litigation challenging various new (and old) regulations, particularly those where a regulator has aggressively reinterpreted an old statute to give itself massive new authority, will also continue. Very interesting to read the document on corporate governance action for government (Manifesto for Business) produced by the UK Institute of Directors.

Without doubt, the Republican electoral trifecta, and the party’s upcoming control of the White House, Senate, and House of Representatives, will bring a reset to federal regulation and the agency landscape. On that score, I am pleased to share an excellent report titled “Trump’s return promises major policy changes”, which examines the likely impact of a second Trump term across a number of legal and regulatory practice areas. I wrote the section on climate policy and was joined by a number of my outstanding Wolters Kluwer editorial colleagues who covered antitrust (Jeffrey May, J.D.), health law (Sheila Lynch-Afryl), tax policy (Anne H.
