Clermont was founded in 1884 and incorporated in 1916, when its main industry was citrus production (that industry thrived until the 1960s). Today, it is the largest city in Lake County, one of the fastest growing counties in Florida. Its historic downtown is the heartbeat of the city, supported by Clermont Main Street, a passionate group of businesses and volunteers working to revitalize the area through a mix of public funding, grants, sponsorships and community events. I PLEDGE my HEAD to clearer thinking, my HEART to greater loyalty, my HANDS to larger service, and my HEALTH to better living, for my family, my club, my community, my country and my world. This is the 4-H Pledge that youth and adults recite at the opening of each meeting. In the spirit of that pledge to clearer thinking, we ask “is there a future for 4-H in Sherburne County?” Last summer, the 4-H horse project funded and painted the barns to freshen them up for fair. Imagine the disappointment as everything the kids worked to prepare for was deluged with rain through the failing roofs on the horse barns as several waves of extreme weather occurred during fair week. The normal flurry of excitement was replaced with an all-out scramble to shift horses to higher ground and wait out the storm while also scrambling to save thousands of dollars’ worth of hay, feed, show clothes, tack and equipment. This is one of many issues that need to be addressed to deal with aging infrastructure and the future of the county fairgrounds. The county has indicated at various times the desire to sell and redevelop the property the fairground occupies. That constant fear of being evicted from the fairgrounds has not served the best interests of the youth or the community at large. Sherburne County businesses and residents are overwhelmingly supportive of 4-H programming when made aware of needs and how they can help. But who will invest in updating and improving the aging infrastructure of a fairgrounds under constant threat of eviction and redevelopment of the property? If the long-range plan is to relocate the fairgrounds, then please, let us begin the dialogue to plan out a timeline and details for beginning that endeavor. We need to at least work together to solve the immediate issues to serve our youth of today as well as plan for the future of our youth. If you fail to plan, you plan to fail. Please, let us not fail our youth any longer. ~ Families of Sherburne County 4-H Note: this letter was sent to all Sherburne County commissioners. One of yesterday’s SCOTUS opinions is going to cause massive debate in cities across the US. In Grants Pass v. Johnson, No. 23-175 (2024), the Supreme Court’s 6-3 conservative majority voted to uphold an ordinance that prohibits any person from camping on public property or parking overnight in city parks. In the decision facing criticism for allowing towns to criminalize the homeless, the Court held that the city’s ordinance did not constitute cruel and unusual punishment under the Eighth Amendment to the United States Constitution because it does not distinguish between “a person facing homelessness, a backpacker on vacation, or a student who abandons his dorm room to camp out in protest on the lawn of a municipal building.” Given the Court’s holding, some cities in Massachusetts may consider adopting a similar Grants Pass-type ordinance to combat the state-wide homelessness issues. My prediction: Expect any such adopted ordinance to face a constitutional challenge under Article 26 of the Massachusetts Declaration of Rights (which like the Eighth Amendment also prohibits cruel and unusual punishment). The SJC has held repeatedly - including just this year - that our state constitution affords broader protections than the federal Eighth Amendment. I would not be surprised if at least some members of the SJC want to criticize Grants Pass’s reasoning as applied to our state constitution.

In my mind, the principle of the right to roam is about balancing private property rights with the public's desire for access to nature. Scotland's approach, establishing a "right of responsible access" to most land and water, provides a compelling model, emphasising responsibilities alongside rights and offering a more unified framework. A mass trespass on Dartmoor is a bit intersection between England's property rights, public access, and history. The protest drew inspiration from the 1932 Kinder Scout mass trespass, a pivotal moment in establishing the right to roam in the UK. England's current system, supported by the Countryside and Rights of Way Act 2000, offers limited rights to roam across specific landscapes—mountains, moorland, heathland, downland, and commons—constituting about 8% of the land. But, these areas of "access land" are often isolated by private properties, creating "islands" of public space that are hard to reach without trespassing.
