Say it ain’t so Joe: I’m in Dallas this week on a matter Only a week off the election and discussions have begun in some circles in #Texas on whether the new administration will ask #Congress to amend the #BankruptcyCode to eliminate the ability of corporations to file where incorporated instead of where the companies are headquartered. Those that support closing that loop hole say it’s in line with the world view of the #Trump administration that certain things should be left to the states. The ability to file bankruptcy was provided by the Founders at the formation of our country after all so that does make sense. #President elect #Trump is probably quite frankly in modern times one of the few examples of letting equity ride through and keeping the case local as his #TajMahal case was administered out of Camden even though it was a Delaware filing and equity road through- highly unusual these days. Full disclaimer I was co-counsel to the equity committee in that case. This is a big issue because when a large public case files local business benefits and it can mean 10’s of millions injected into the local economy— not to mention small business creditors know where to find the courthouse to express their views but can’t often afford to travel to places like #NewYork for hearings— some say frozen out of the process. For some time Senator Cornyn was thought to be the one to spearhead the change but most saynthat was a tool to make a deal with then #SenatorBiden. Yesterday a friend of mine long ago Texas native said perhaps “Politicians who care about the people like #Congressman #ChipRoy might take up the mantle to get a Bill rolling in the new administration. Any politicians including #SenatorGraham have raised donations for their campaigns in #Delaware pledging support to leave the rule in place. But it’s a new day, President #Biden is nearing the end of his term and #Trump is in— but it remains to be seen- efforts to change the rule have failed over the last 20 years— no reason to think it will change now- but… “never say never.” #Bankruptcy
