We're thrilled to hear that the House failed to pass H.R. 9495. While the bill purported itself to be an anti-terrorism bill we know the truth. The reality is that the US government was attempting to use the legislation against pro-Palestinian and other rights groups that dared challenged their authority. Financing terror groups is already illegal. This legislation hid their true intent behind the mask of fighting terrorism.?
With Donald Trump winning the presidential election this could have been detrimental for grassroots organizations fighting injustices. Civil rights advocates had widely condemned the proposed legislation because they knew all too well against who it would be enforced.
We're living in an increasingly, fascist country. This legislation aimed to strip tax-exempt status from nonprofits if they were deemed to provide "material support" to designated terrorist groups. This could be determined unilaterally by the U.S. Treasury without a clear, neutral process, raising concerns about potentially stifling free speech and advocacy by targeting nonprofits that might simply support controversial or unpopular causes.
Additionally, the bill’s vague criteria and lack of due process safeguards meant that nonprofits could face substantial financial and reputational damage before being able to appeal any designation. This was especially concerning seeing as such a provision could deter donors, chill dissent, and impose legal and financial burdens that might cripple certain nonprofits like Yellowhammer Fund in our fight for Reproductive Justice in states riddled with reproductive oppression.
We caution people from believing that because it didn't pass this past Tuesday is indicative that is will never pass. Like we saw with the reversal of Roe v. Wade our opponents are a tenacious bunch. Now that Donald Trump has won the election and republicans have taken over we may soon see legislation like this again.
