The Community Associations Institute has approved moving forward with a lawsuit challenging the application of the Corporate Transparency Act's beneficial owner reporting requirements towards community associations. This #lawsuit joins the ever-increasing number of cases filed against the #CTA. Thank you to all who joined us for the FINAL Catalyst meeting of 2024! We had an incredible discussion on the process of legislation featuring Florida House of Representative Berny Jacques and District Aide Audette B. exploring how bills are sponsored, how they move through committees, and eventually become law. ?? This conversation was a "Call to Action" in our final pillar of "Involvement". Here is a recap of our discussion! When drafting a proposed bill, the following factors are crucial: ?Does the bill align with the community’s values? ?Is it crafted in a way that resonates with various stakeholders? ?Will it benefit constituents & are there unintended consequences? ?In the House of Representatives, a legislator can file up to 7 bills. ?With only 40 members, The Senate can file unlimited bills. ?A bill must be approved in both chambers to become law. ? Legislators have access to a bill drafting department that helps transform ideas into formal legislative proposals. ? The Office of Bill Drafting ensures that every proposed bill complies with Florida’s constitution. ? Early engagement with government entities and stakeholders is crucial in navigating potential challenges to a proposed bill. ? Failing to build consensus or involve the right parties early on can significantly hinder a bill's chances of passing. ? Effective communication allows representatives to craft policies that directly address the needs of their constituents. When are judges not qualified to make decisions that require technical expertise? It seems that after the recent overturning of the Chevron defense, technical expertise and training are irrelevant when it comes to interpreting the law about agencies of the government. Either side of an issue can bring in competing "experts." Judges will be expected to make determinations without the adequate training to understand the issues and without understanding whether the consequences of their decisions are in line with what Congress intended when creating and empowering an agency, based on their own biases and lack of knowledge on the subject in question. Congress needs to make it clear as to what they mean when they empower agencies to make rules and guidelines and what authority can interpret them so that the intent of Congress is preserved. This ruling undermines both the executive and legislative branches of government and is at odds with the Supreme Court's other recent "immunity" ruling that further empowers the President at the expense of Congress and the Courts. This problem is further compounded by having federal courts all over the country with different expertise make decisions that affect the entire country. Another option would be to have specialty courts (like FISA or maritime courts) for cases regarding federal agencies. Congress could empower such courts when they set up or enact legislation about agencies. https://lnkd.in/eQj7kja8

The AAT is/was responsible for conducting independent merits review of administrative decisions made under Commonwealth laws.?The AAT function was to to review decisions made by Australian Government ministers, departments and agencies and, in limited circumstances, decisions made by state government and non-government bodies. Happy to share that my joint work with Prof. Eyal Pe'er and Prof. Yuval Feldman "affidavit aversion: Public preferences for trust-based policy instruments" was?published in the special issue on Rules and Data in?Regulation & Governance. Our study shows that people exhibit aversion towards using affidavits despite the significant benefits that they offer compared to the traditional bureaucratic procedure, and suggests that honesty pledges may be a powerful tool in promoting public compliance as they are largely preferred by the public and also involve relatively limited risk of exploitation.
