Across the globe, border security is fraught with technical, geopolitical, ethical, and logistical challenges. Borders demonstrate a nation’s ability to protect and define itself. Yet, their vulnerability lies in the fact that border terrain is often difficult to patrol, a corridor of illicit activities, and a nexus for humanitarian crises. Countries cannot build walls to keep everyone out, and there will never be enough border agents to patrol every section of a remote border. No single technology or strategy can offer complete protection against the most significant modern threats to the nation-state. Glad to receive the certificate of attendance of the specialist course on #International #Maritime #Security #Law which held from 27 March to 31 May 2024, organized by the International Maritime Law Institute (IMO IMLI). The said course was specifically designed to address the various critical maritime security #threats to the international #rule of law at #sea and the #freedom of #navigation. The newly emerging #challenges and transformed threats, which include, maritime #terrorism, #drug #trafficking, #migrant #smuggling and use of #unmanned #vessels, are largely unregulated in the #United #Nations #Convention on the #Law of the #Sea 1982 and this has led to the adoption of various international #conventions and #protocols. It is worth mentioning that the aforementioned course covered the gravity of these threats and the existing applicable international laws and #State #practices deterring the same. #IMO #Maritime #Legislation #Security #Shipping

FIRST - understanding WHY piracy, under UNCLOS, cannot be applied to attacks by HOUTHIS on shipping on the Red Sea; SECOND HOW these attacks come under ambit of "offence" as per SUA Convention; New Security Risks to International Shipping Article 101 of UNCLOS definition of piracy, the following stand out as key elements: i. "Location of the Crime" - international waters & the High Seas i.e. waters beyond the territorial sea; ii. "Two Vessels Requirement", and iii. "Private Ends Requirement". New Security Risks to International Shipping Article 101 of UNCLOS - Piracy, thus, CANNOT be applicable in case of HOUTHIS' attacks on shipping. All other elements being equal, the act on shipping by the HOUTHIS thus constitutes an "offence" under the SUA Convention. Historical background to the SUA Convention - ALSO perceived as a "Counterterrorism" Treaty. The Way Forward ? Ship-owner choosing to place armed guards on-board endeavours to protect the multi-million dollar asset; and on other, also end up protecting the territory of the flag State by default! So, why can't this cost be shared between the ship-owner & the flag State?...A point in moot!
