In March 2024, Indiana Gov. Eric Holcomb signed a bill that states any future trusts must be given out within 360 years from when it starts. This rule will affect all trusts beginning on or after July 1, 2024, except for charitable ones. If the trust says the benefits need to be given out sooner, then that earlier time will be followed. @National Law Review shares interesting insights on this update that will be relevant for estate planners and their clients. A Matter of Trust: Unraveling the Threads of Legal Confidentiality and Misleading Representation Part 4 Continuation of California State Bar Rules of Professional Conduct “Rule 1.6 ?Confidential Information of a Client-A lawyer shall not reveal information protected from disclosure by Business and Professions Code section 6068, subdivision (e)(1) unless the client gives informed consent.” Do you recall Harry Bower? On October 14, 2021, a different attorney who had previously worked for the nonprofit organization represented him as a client of their nonprofit organization. Well, in 2022 we started our San Francisco lawsuit. However, the name of Harry Bower was disclosed in a Summary Judgment motion by our tenants' attorney, who represents this nonprofit organization. Given that Harry Bower's case was resolved before ours did, I'm positive he did not consent to his name being included in ours. The attorney representing our tenants blatantly breached the confidentiality information regarding former client of the organization she works for. “CHAPTER 7. ?INFORMATION ABOUT LEGAL SERVICES Rule 7.1 ?Communications Concerning a Lawyer’s Services (a) A lawyer shall not make a false or misleading communication about the lawyer or the lawyer’s services. A communication is false or misleading if it contains a material misrepresentation of fact..” The defendants' attorney in our San Francisco case misrepresented or gave false information about the lawyer's services, despite working for a nonprofit organization that protects the elderly and disabled in San Francisco. She represented two men at the time, one of whom was 41 years old and the other was 61. This went against the mission of the organization she works for and in contrast to their mission, she victimized us—the plaintiff, who is 70 years old at that time and has diabetes, and his wife, who has complex disabilities. Watch out for Part 5 of this blog about the California State Bar Rules of Professional Conduct and continuation of how a lawyer break rules and got away without being sanctioned!
